[USA HERALD] - In a perfect world, we’d all promptly report incidents to our insurance companies, giving notice the minute something happens. But life gets in the way, and sometimes, that call to your insurer slips through the cracks. So, what happens if you’re a little late to the party?

As a legal journalist, I’ve covered my share of insurance disputes, and the “notice-prejudice” rule is an intriguing one. This rule, recognized in states like Illinois and California, says that if an insured fails to give notice on time, the insurer can’t automatically deny coverage—unless it can show that the delay caused them harm, or "prejudice."

Take Illinois, for instance. Recently, an Illinois federal court ruled in Old Republic Insurance Company v. Ideal Aviation Illinois, LLC, a case that highlights just how nuanced this issue can be. The insureds were months late in notifying Old Republic, their aviation insurer, about an accident. A propeller had injured someone on their plane, a serious incident to be sure. But despite the ten-month delay, the court found the insured’s notice reasonable because the insurer hadn’t been prejudiced.

Breaking Down the Case

In this case, the insured party rented aircraft, and their policy required “as soon as practicable” written notice following an incident. On July 5, 2021, a person was seriously injured by a propeller on their plane, but the insurer, Old Republic, wasn’t notified until nearly a year later. Even so, when Old Republic tried to use the late notice as a reason to deny coverage, the court sided with the insured. They said that because the insurer had time to investigate before any lawsuits were filed, they couldn’t claim harm.

Illinois courts weigh five factors when deciding if notice was “reasonable.” These factors include policy language, the insured's understanding of insurance, whether they knew of an event triggering coverage, and most importantly, whether the delay harmed the insurer’s ability to investigate or gather evidence. Without prejudice to the insurer, a late notice may not sink a policyholder’s coverage.

The ruling here reminds policyholders: while prompt notice is always the best route, a delay doesn’t automatically mean coverage is off the table. If your insurer hasn’t been hurt by the delay, they may still need to defend you.

Why Should This Matter to You?

The court’s decision in Old Republic reiterates a crucial point: notice requirements are important, but courts also care about fairness. If you’re dealing with a similar situation, remember that states like California and Illinois expect insurers to demonstrate prejudice if they’re going to deny your claim on the basis of late notice.

And here’s something you may not know: depending on your state, policies may have different requirements based on whether they are “occurrence” policies (covering events when they happen) or “claims-made” policies (covering claims when they’re reported). The notice-prejudice rule may apply differently depending on this distinction, so be sure to read your policy closely.

So, as with many things in the law, timing and diligence matter. And if you’re in a dispute, remember: prejudice—or lack thereof—could be your best defense.
