What This Fight Is Really About

• New York says Polymarket runs unlicensed gambling that lets 18-year-olds stake money on sports.
• Polymarket fires back that federal CFTC rules alone control its event contracts.
• The same baseball outcome draws different age limits and protections depending only on the app’s button label.

New York Attorney General Letitia James and Governor Kathy Hochul dropped a lawsuit on September 24th against QCX LLC, the U.S. arm of Polymarket. They call its prediction markets an illegal gambling operation. The state wants a court order shutting the platform down in New York, forcing it to hand over alleged illegal gains, pay restitution to users, and face fines equal to three times those gains plus $100,000 for every unauthorized sports wager offer.

Polymarket launched its U.S. platform in December 2025 with sports contracts first, then ‘markets on everything.’ Users put real money on outcomes they can’t control—baseball scores, geopolitics, Alien Abduction, the GTA VI Release.

One of the more bizarre prediction markets involved an “Alien Abduction” contract, which required documented evidence that an individual had actually been abducted at a stadium. As strange as that may sound, traders put more than $4.3 million into the market.

In New York, an account spent $3.01 on contracts that the Mets would beat the Braves. The Mets won. The account collected $6.39. The state says that is a bet under New York law.

Polymarket never got a license from the New York State Gaming Commission. Licensed sportsbooks and casinos pay taxes that fund schools and problem-gambling treatment. Polymarket does not.

The age gap stands out. New York bars mobile sports betting under 21. Polymarket lets 18- to 20-year-olds in. The lawsuit also flags contracts on New York college teams—Syracuse, St. John’s, Buffalo, Albany—wagers even licensed books cannot offer.

Governor Hochul said the company put New Yorkers at risk, “especially those underage who are most vulnerable to problem gaming.” Attorney General James added that skirting the rules targets the vulnerable and starves families of public services.

Hours later Polymarket sued back in federal court. It argues the Commodity Futures Trading Commissionholds exclusive power over these event contracts as derivatives. State gambling laws, the company claims, cannot touch a federally designated contract market.

The firm says New York is forcing an impossible choice: shut down nationwide operations or risk huge liability. Similar suits already hit Kalshi, Coinbase Financial Markets, and Gemini Titan. Here is the practical question the legal labels dodge. Two apps let people stake the same cash on the same baseball result. One button says trade. The other says bet. Does that single word justify different age floors, different addiction safeguards, different tax treatment?

Federal oversight may decide who writes the rules. It does not decide what rules users actually need. Prediction markets can produce sharp probability signals. They can also produce the same financial and mental-health damage that regulated gambling triggers.

The American Psychological Association links gambling disorders to high rates of suicidal ideation. New York’s licensed operators must build in cooling-off periods, self-exclusion tools, and age checks. Polymarket, under pure federal derivatives rules, faces none of those state mandates.

The company is valued above $20 billion with strong revenue. It markets itself as legal in all 50 states. New York disagrees. Courts will sort the preemption fight. Until then, an 18-year-old in Brooklyn can open an app, put money on tonight’s Mets game, and face fewer protections than the same 18-year-old using a licensed sportsbook. That difference rests on a label, not on any change in the risk the user takes.
