The footwear giant, Crocs and its charm subsidiary, Jibbitz, filed suit September 18 in the U.S. District Court for the District of Colorado. The target - Five Below's Juniors Charm Clog, a shoe that sells for $7 and, according to Crocs, borrows heavily from the silhouette that made the company a household name.

Look at the two shoes side by side and the complaint's argument isn't hard to follow. Crocs points to the hole pattern, the trapezoid-shaped vents, the textured band running across the top. These aren't random design flourishes — they're the exact features that make a Classic Clog recognizable from across a pool deck. Crocs argues the resemblance is close enough that shoppers could think Five Below's version carries some kind of official blessing.

The charms matter just as much as the shoes. Jibbitz holds three patents covering how decorative charms snap onto footwear and other gear, and the lawsuit says Five Below's charm system rides on that same mechanism. There's also a name check for Five Below's Novelty Shoe Purse, which Crocs says lifts design cues from both the Classic Clog and one of its own bag charms.

None of this is coming out of nowhere. Crocs says it sent Five Below a demand letter back on March 4, laying out its intellectual property concerns in detail. Five Below got the letter — the lawsuit says the company acknowledged as much. And then, according to Crocs, it kept selling the clogs anyway.

That's the part that turns this from a design dispute into a legal fight with teeth. Six months is a long runway between a warning and a lawsuit, and Crocs is framing that gap as a choice — evidence that Five Below decided the profit was worth the risk.

The math explains why. Crocs' Kids Classic Clog runs $39.99. Adult versions land between $50 and $65. Five Below's version undercuts all of it at $7, though the retailer's website currently shows every variation sold out online. Crocs' complaint is blunt about what it thinks happened: Five Below spent nothing building brand recognition and cashed in on Crocs' decades of doing exactly that, at a fraction of the price.

Clogs themselves have no owner. The shoe traces back to 13th-century Europe, where Dutch farmers wore wooden versions built for durability in muddy fields, not fashion. Crocs isn't claiming it invented the clog — it's claiming it owns specific design choices layered onto that centuries-old shape, the same way a car company can't patent wheels but can own a distinctive grille.

Crocs and Jibbitz are asking for a jury trial, unspecified damages including lost profits, a permanent injunction blocking further sales of the disputed products, attorneys' fees, and destruction of what they call infringing inventory. That last request is the aggressive one — it's not just stop selling, it's get rid of what you've already made.

Five Below hasn't filed a public response yet. Until it does, the case sits exactly where Crocs wants it: a discount retailer facing a jury over a $7 shoe, with a $65 competitor arguing that cheap doesn't mean it gets to skip the rules.
