WASHINGTON - Brussels wanted its money, and it wanted more than X Corp's checkbook to get it. Now the U.S. government is stepping in front of a Luxembourg courtroom to say no.

On Thursday, the Department of Justice filed papers to intervene in two linked cases — X Internet and X Holdings v. Commission, and Musk v. Commission — sitting before the General Court of the Court of Justice of the European Union. Both cases stem from a December 5, 2025 decision that hit X and Musk with a joint fine of €120 million, roughly $130 million, for violating the EU's Digital Services Act. The number wasn't pulled from X's ledgers alone. The Commission calculated it off the total worldwide turnover of what it called "the single economic unit" controlled by Musk.

That phrase is the whole fight.

Assistant Attorney General Brett Shumate didn't mince words about it. "The European Commission inappropriately attempted to expand its regulatory authority to reach American companies not present or operating within its jurisdiction," he said, adding that the department "will not tolerate" what he called regulatory overreach aimed at "American engines of innovation and economic growth."

Here's the mechanism the U.S. is challenging. Under Article 40 of the EU Court's governing statute, outside parties — including entire nations — can intervene in a case if they can show a real stake in the outcome.

The Justice Department says the U.S. has one, and a big one. Brussels' theory of who counts as a "provider" under the Digital Services Act didn't stop at X. It reached toward Musk personally, and by extension, toward other companies he owns that have nothing to do with X, social media, or digital platforms at all.

That's the part that should worry more than just Musk. American corporate law runs on the idea of a corporate veil — the principle that owning a company doesn't make you legally the same thing as that company, and it doesn't make your other businesses fair game either. It's not a technicality. It's foundational to how American business structures liability, raises capital, and separates risk across ventures. If a foreign regulator can punch through that veil because one entity you own broke a rule, the exposure for any founder or investor with a diversified portfolio gets a lot messier.

The Justice Department coordinated with the State Department on the filing, which tells you this isn't being treated as a corporate legal dispute that Washington happens to have opinions about. It's being treated as a jurisdiction fight with consequences for U.S.-EU relations broadly.

The government's stated interest is making sure any ruling lines up with how territorial jurisdiction is supposed to work under international law — meaning a regulator's authority should track where a company actually operates, not stretch to grab whatever assets are attached to the person who owns it.

This is also a first. No DSA enforcement case has reached the General Court before this one. Whatever the judges decide here becomes the template — for X, and for every other U.S.-based platform Brussels has labeled a "very large online platform" under the same law.

Most of those platforms are headquartered, at the parent-company level, in the United States. A ruling that upholds Brussels' approach doesn't just cost Musk money. It hands European regulators a blueprint for how far they can reach into American corporate structures going forward.

The case is now in the General Court's hands in Luxembourg, with the U.S. government asking to be heard as a formal party to the fight, not just a bystander watching from Washington.
