Amazon Traces Transactions, Blocks Account, Refunds Buyers
Amazon stated in the complaint that it used information collected during the Jomspo account’s creation to identify financial transactions tied to the counterfeit activity. Once the sales were confirmed, the online retailer blocked the account from further selling and moved to refund customers who unknowingly purchased the forged Zevo goods.
Claims Include Trademark Counterfeiting and Contract Breach
The suit brings forward several claims: trademark counterfeiting and infringement, false designation of origin, violations of the Washington Consumer Protection Act, and breach of contract for violating the terms of the BSA.
The action also follows other recent Amazon lawsuits accusing Chinese manufacturers of falsely promoting their electric scooters and e-bikes as certified by safety organization UL LLC, signaling an intensified crackdown on fraudulent product listings.
