American Eagle Outfitters Inc has reached a settlement agreement with Amazon.com Services LLC, resolving a legal dispute over the alleged unauthorized use of American Eagle’s Aerie trademarks. The agreement brings an end to a trademark infringement lawsuit filed by American Eagle in September 2024.
The Aerie Amazon Trademark Settlement stems from claims that Amazon used Aerie’s registered marks, including those related to its “Offline by Aerie” collection, in online advertisements and search engine results without authorization, allegedly misleading consumers into believing Aerie products were sold on Amazon.
A dismissal order was filed this week in the U.S. District Court for the Southern District of New York by Judge Jesse M. Furman. The case may be reopened within 60 days if the settlement is not finalized.
In a joint letter submitted to the court, both parties confirmed they had “agreed in principle on the terms of a settlement that will resolve all of AEO’s claims against Amazon.” A 60-day stay was requested to complete the terms of the deal.
American Eagle asserted in its complaint that it had never authorized Amazon to use its Aerie marks and had declined Amazon’s requests to sell Aerie merchandise in order to maintain its brand identity and customer experience. Amazon, in its response, denied any infringement or wrongdoing under federal or state law.
