Former President Joe Biden has launched a new legal battle as Biden Sues Justice Department. Headlines continue to dominate political and legal discussions in Washington.

Biden is attempting to block the release of audio recordings and transcripts from interviews conducted with the ghostwriter of his memoir, arguing that the conversations were deeply personal and protected by privacy rights.

The recordings stem from interviews Biden conducted in 2016 and 2017 with writer Mark Zwonitzer while working on his memoir, Promise Me, Dad: A Year of Hope, Hardship, and Purpose. The United States Department of Justice has informed Congress that it plans to release the materials to the House Judiciary Committee on June 15.

Biden Sues and Argues Personal Conversations

According to court filings submitted in federal court in Washington, Biden’s attorneys argue that the recordings contain highly personal discussions, including emotional conversations about the death of his son, Beau Biden.

Lawyers for the former president stated that every American, including former elected officials, has a reasonable expectation of privacy regarding conversations conducted inside their own homes.

The legal filing contends that the Justice Department itself previously defended keeping the recordings private while Biden was serving as president.

“Every American, including a sitting or former Vice President, has a right to privacy in the personal conversations he has within his own home,” Biden’s legal team argued in the filing.

The interviews reportedly touched on Biden’s grief following Beau Biden’s death and how that tragedy influenced his decision not to run for president in 2016.

Why the Justice Department Has the Tapes

The recordings became part of a federal investigation conducted in 2023 and 2024 into Biden’s handling of classified documents after his vice presidency.

Special counsel Robert Hur investigated whether Biden improperly retained sensitive materials and discussed national security matters with Zwonitzer while preparing the memoir.

Hur ultimately declined to bring criminal charges against Biden. However, portions of the investigation generated political controversy after heavily redacted transcripts were publicly released.

The audio recordings themselves have not yet been made public.

House Republicans Seek Full Release

The push for disclosure has been strongly supported by Republicans, particularly members of the House Judiciary Committee led by Jim Jordan.

Jordan has argued that the public deserves to hear the recordings in full, claiming they could shed light on Biden’s mental sharpness before and during his presidency.

“I think it’s just important for the American people to know exactly where the President of the United States was,” Jordan reportedly said in May.

The controversy comes amid ongoing political tensions between allies of Biden and supporters of President Donald Trump regarding executive power, privacy, and transparency.

Biden Sues in Separate Fight Involving Heritage Foundation

Biden is also involved in another lawsuit seeking to prevent the conservative Heritage Foundation from obtaining the same tapes.

The Heritage Foundation has argued that the recordings could provide insight into Biden’s cognitive condition before he entered the White House.

A federal judge recently ruled that Biden should be allowed to challenge the organization’s request for the materials in court.

Biden Sues: Debate Over Privacy and Public Interest Continues

Legal experts say the case could have broader implications regarding privacy rights for current and former public officials.

Supporters of Biden argue the recordings involve private reflections and emotional family matters that should not be weaponized politically. Critics, however, maintain that materials connected to a federal investigation involving a president are inherently matters of public concern.

The dispute is expected to continue playing out in federal court as the June 15 release date approaches.
