A long-standing legal battle involving accusations of copied robot toy source code between Pittsburgh-based Digital Dream Labs Inc. (DDL) and Chinese company Living Technology (Shenzhen) Co. has concluded with a settlement, according to documents filed in federal court on Tuesday.

Chinese Robot Code Source Lawsuit : Details of the Settlement

The lawsuit centered on allegations that Living Technology, also known as Living.ai, copied the source code from a unique interactive menu system used in DDL's "Vector" robot toy—a system visually displayed through the toy’s eyes. According to court filings, both companies have agreed to drop all claims and counterclaims "with prejudice," which means another lawsuit concerning the same issue cannot be pursued.

U.S. District Judge Christy Criswell Wiegand officially dismissed the Chinese Robot Code Source Lawsuit on Wednesday, following a stipulation from both parties to end their legal dispute under an undisclosed settlement.

The Core of the Dispute

Originally, DDL had acquired the intellectual property rights for the Vector robot toy from Anki Inc., which had ceased operations. The dispute ignited when Living.ai reportedly purchased several Anki demonstration robots at auction, subsequently reverse engineering certain aspects of the Vector's source code to use in their own robot toy, the "Emo."

The accusations extended to the specific sequence required to access the Vector’s developer menu, a feature intricately designed to be activated by arranging the robot's movable parts in a precise configuration, with the outcome displayed on what are effectively the toy's eyes.

Chinese Robot Code Source Lawsuit : Progress Towards Resolution

While the specifics of the settlement have not been made public, David Oberdick of Meyer Unkovic & Scott LLP, representing DDL, emphasized that both parties have reached a mutual release of claims and acknowledged each other’s intellectual property rights. He noted that no further comments would be made regarding the particulars of the agreement.

In contrast, the legal representatives for Living Technology declined to comment on the resolution of the lawsuit.

Legal Maneuvers and Court Proceedings

Throughout the legal proceedings, DDL consolidated this case with another lawsuit alleging additional instances of code copying by Living.ai. The court extended several deadlines, attributing delays to language barriers and logistical challenges in coordinating among dispersed parties involved in negotiating the settlement.

Judge Wiegand had previously denied a motion by Living.ai to dismiss DDL's infringement claims in January 2023, citing sufficient similarities between the contested source codes to warrant further examination.

This lawsuit underscores ongoing international concerns regarding intellectual property rights in the competitive tech industry, where innovations like robot toys often involve complex legal considerations about source code and design copying.
