Sparse Indictment Raises Questions
The September indictment accuses Comey of lying to Congress in 2020 when he denied authorizing anyone at the FBI to act as an anonymous source for media reports about investigations involving Trump. The document, fewer than 300 words, provides few specifics — notably omitting the identity of the person Comey allegedly authorized.
Fitzgerald said the defense has not received discovery materials and has no information about the mysterious “Person 3” referenced in the indictment. Lemons acknowledged that much of the evidence is classified, which could complicate proceedings.
Judge Pushes for Speedy Disclosure
Judge Nachmanoff, however, warned prosecutors against using classified information as an excuse to stall.
“I will not let this case get off track because of slow disclosures,” he said. “This isn’t an overly complicated matter.”
Fitzgerald countered that prosecutors should have handled classified materials before filing charges. “The cart may have been put before the horse,” he remarked pointedly.
