NEW YORK — Costco Wholesale Corporation, the retail giant whose business model is built around offering customers lower prices, is facing a new federal class action lawsuit alleging that consumers were misled by pricing representations that made certain purchases appear more attractive than they actually were.

The lawsuit, Howell v. Costco Wholesale Corporation, was filed November 6, 2026, in the U.S. District Court for the Eastern District of New York, case number 1:26-cv-07168.

The proposed class action challenges allegedly deceptive discount representations that may have led consumers to believe they were receiving greater savings than the products actually offered.

The case is still in its early stages, and Costco has not been found liable, and the allegations remain unproven.

But the controversy raises a question worth examining: When retailers advertise savings, what evidence establishes that the savings are real?

Under the Federal Trade Commission's Guides Against Deceptive Pricing, businesses should not manufacture the appearance of discounts by comparing current prices against inflated or fictitious former prices.

Consider an item normally offered for $50. If a retailer temporarily lists it at $80 before advertising a reduction back to $50, shoppers could reasonably believe they saved $30—even though they paid the ordinary price.

That hypothetical illustrates the problem federal regulators have long recognized. It does not establish that Costco employed such a practice.

For plaintiffs alleging misleading reference prices, the evidence often lies in historical price records, promotional materials, transaction data and the duration for which merchandise was genuinely offered at its supposed original price.

There is another consideration particular to Costco.

Unlike traditional retailers, Costco charges annual membership fees, with shoppers paying for access to merchandise marketed around competitive prices and value.

According to the company's 2026 annual report filed with the Securities and Exchange Commission, Costco reported approximately 84.1 million paid memberships and $5.9 billion in annual membership fee revenue.

That membership structure makes consumer confidence especially important. Customers are not merely evaluating individual purchases; they are also deciding whether continued access to Costco's advertised value justifies an annual fee.

The newly filed lawsuit is not the company's only recent encounter with allegations concerning promotional representations.

Costco's own SEC disclosures identify Zydel v. Costco Wholesale Corp., a Washington lawsuit alleging misleading promotional email subject lines, including purportedly deceptive time-limited sales. Costco reported agreeing to a class-wide settlement for an amount it considered immaterial.

A separate July 2026 lawsuit, Jay v. Costco Wholesale Corp., similarly alleges misleading limited-time promotional emails under consumer email protection statutes in multiple states.

Those proceedings concern different allegations and do not establish misconduct in the Howell pricing case.

Nevertheless, they identify an area deserving closer examination: the accuracy of marketing claims used to persuade consumers that purchasing opportunities represent exceptional value.

The larger legal question is whether the alleged pricing representations were isolated instances or resulted from standardized practices affecting numerous purchasers.

For class certification, plaintiffs would generally need to satisfy Federal Rule of Civil Procedure 23, including requirements addressing common questions, representative claims and the suitability of class-wide proceedings.

That determination has not been made.

The next meaningful development will be the examination of Costco's response.
