[Lebanon County] - Pennsylvania’s Superior Court found that a Lebanon County judge violated public-access rights by sealing records in Veronika Rodriguez’s false rape report prosecution without explaining why.

Writing for a three-judge panel, Judge Brandon Neuman called the handling of the records and the news outlets’ requests “a clear abuse of the court’s discretion.” The ruling reversed the May 19, 2025 denial of intervention and access sought by LebTown, PennLive, LNP Media Group and WITF. (June 10 memorandum, pp. 1, 16.)

Rodriguez was convicted May 23, 2025 of interception of communications, disclosure of communications and false reports to law enforcement. (Memorandum, p. 4.) Her August 20 sentence included 30 days in jail. Prosecutors said recordings and messages contradicted her account of a sexual assault that ruined a military doctor's life.

Equal Justice Solutions, which said it did not represent Rodriguez, disputed the prosecution’s interpretation and criticized restrictions on expert testimony. The access ruling did not resolve those criticisms or overturn the conviction. Firm’s statement

The three sealed records were a February 10, 2025 prosecution motion seeking permission to send recordings for transcription, the order granting it, and a May 2 motion seeking admission of cellphone evidence. The latter included messages, recordings, photographs and social-media material. (Memorandum, pp. 2–3.)

The court identified a striking inconsistency:

“Moreover, the Commonwealth never even sought the sealing of its Motion in Limine, and the substance of the motion was extensively discussed (and displayed) at the public hearing on May 1, 2025.”

Neuman added: “Again, the court sealed this document without any hearing or statement of its reasons for that decision.” (Memorandum, p. 15.)

The panel also found the judge improperly denied the outlets an opportunity to be heard. Their request to intervene—to participate for the limited purpose of seeking records—required consideration separately from whether access should ultimately be granted. (Memorandum, pp. 13–14.)

The decision invokes Pennsylvania’s constitutional presumption of open courts and explains why general concerns about pretrial publicity do not, by themselves, justify withholding judicial records. Its constitutional finding is explicit: the trial court “violated Appellants’ First Amendment right of access”. (Memorandum, pp. 9, 15 & n. 7.)

Footnote 7 distinguishes the standards: common law requires balancing the presumption of openness against reasons for sealing; the First Amendment requires a compelling government interest and restrictions narrowly tailored to serve it.

Access also took longer than the trial court initially represented. In July 2025, it said the records had been unsealed after trial. The outlets subsequently reported that the disputed entries remained sealed. On August 22, the Superior Court directed unsealing and a response within seven days; the trial court reported compliance September 8. (Memorandum, pp. 4–5.)

That eventual disclosure did not eliminate appellate review. “They are capable of repetition, will likely evade review in future criminal cases,” Neuman wrote of the claims. In practical terms, temporary secrecy can end before an appeal is decided, leaving the underlying practice unexamined. (Memorandum, p. 7.)

Recordings and texts can help test conflicting accounts, but their authenticity and context still matter. Pennsylvania also recognizes exceptions to its recording restrictions, including certain recordings based on reasonable suspicion of violent crime. This access decision did not determine whether an exception protected Rodriguez. Pennsylvania Rule 901, Wiretap Act § 5704(17)

Rodriguez’s separate criminal appeal, 175 MDA 2026, was then pending. USA Herald could not retrieve the live docket or verify a later disposition through September 13. (Memorandum, p. 4 n. 5.)

The records ruling ended with a precise limit: “As the entire record in this case has since been unsealed, no further relief is necessary.” (Memorandum, p. 16.)
