In a separate memorandum also filed Monday, Dr. Kotler reaffirmed his opposition to the dismissal motion, emphasizing that although the venue transfer is now a mutual agreement, it should not result in the dismissal of any claims.

Kotler argued that since the transfer resolves the jurisdictional dispute, the court should preserve the substance of the allegations as the case moves forward in New Jersey.
