Roy and Trumbull’s legal team, consisting of Shannon Liss-Riordan, Krysten L. Connon, and others from Lichten & Liss-Riordan PC, along with Mark J. Gottesfeld and his colleagues from Winebrake & Santillo, represented the drivers. FedEx’s defense was mounted by a roster of legal heavyweights from Wheeler Trigg O’Donnell LLP, Fisher Phillips, and Spotswood Sansom & Sansbury LLC.

The dispute revolves around FedEx’s practice of hiring drivers through intermediary companies rather than treating them as direct employees. This classification, contested in courts nationwide, has been the crux of the drivers’ claims for unpaid overtime. Despite the settlement, the case underscores ongoing debates about worker classification and wage entitlements in the gig economy.

FedEx spokeswoman Heather Wilson stated that the company opted for settlement after the collective was decertified in March, reaffirming its stance that the independent service providers were the legitimate employers. Meanwhile, the drivers’ representatives had no immediate comment.
