Google’s €4 Billion Blow: EU Court Adviser Backs Record Antitrust Fine

Google €4B Antitrust Fine

In a dramatic turn for Big Tech's battle in Europe, Google has suffered a crushing setback in its attempt to overturn a historic €4.1 billion ($4.7 billion) antitrust fine, after a top legal adviser to the European Court of Justice recommended dismissing the appeal outright. The case revolves around Google's alleged abuse of its dominant Android operating system to cement its grip on the mobile internet.

A Nonbinding But Powerful Strike

On Thursday, Advocate General Juliane Kokott delivered a nonbinding—but highly influential—opinion that supports the European Commission’s 2018 decision, which found Google guilty of engaging in anti-competitive practices. These included forcing smartphone manufacturers to pre-install its apps—like Google Search and Chrome—and setting them as default, thereby crowding out competitors and curbing consumer choice.

In the high-stakes legal saga, Kokott concluded that Google failed to provide sound legal grounds for the fine to be overturned. “None of the arguments put forward by Google are effective,” Kokott said bluntly, striking at the heart of the tech titan’s multi-year legal battle.

Status Quo Bias and the Invisible Hand of Pre-Installation

Google had argued that the General Court (which previously upheld most of the penalty in 2022) did not perform a proper “counterfactual analysis”—an assessment of what the market might look like had Google not imposed the pre-installation requirements on Android phone makers.

But Kokott dismissed this, emphasizing the psychological grip of the “status quo bias”—users are naturally inclined to use what comes pre-installed. This silent but powerful influence, she said, unfairly tipped the scales in Google’s favor and was not something competitors could easily overcome.

Partial Win, But a Losing Strategy

Google had clawed back a minor victory in 2022 when the General Court sliced €215 million off the original €4.34 billion fine. It ruled that the Commission lacked sufficient evidence regarding one aspect of Google's pre-installation requirements linked to ad revenue.

Nonetheless, Kokott maintained that the broader pattern of market dominance remained intact. “Despite that partial annulment, Google pursued an overall strategy to secure the future of mobile internet—while safeguarding its own advertising-driven business model,” she said.

Google Responds: Disappointment and Warnings

A Google spokesperson responded , expressing disappointment:

“Android has created more choice for everyone and supports thousands of successful businesses in Europe and around the world.”

The company warned that upholding the fine could "discourage investment in open platforms" and damage the Android ecosystem, affecting users, developers, and partners alike.

Storm Clouds in the U.K.

This isn’t the only legal cloud hanging over Google’s empire. In the U.K., the Competition Appeal Tribunal has greenlit a £7 billion ($9.4 billion) class action alleging that Google stifled competition by securing an exclusive deal with Apple to dominate search results on iPhones.

Moreover, a coalition of British businesses launched a separate £5 billion lawsuit, claiming the tech firm manipulated its search engine to overcharge them for placement—another potential billion-dollar bruising.

As Google faces intensifying scrutiny on both sides of the Atlantic, this latest blow in Europe could set a precedent with ripple effects that challenge the very foundation of its mobile strategy.
