In a thunderous courtroom rebuke, a Massachusetts federal judge on Monday blocked the National Institutes of Health (NIH) from pulling the plug on hundreds of grant programs across the country—programs that touch everything from COVID-19 and climate change to diversity, equity and inclusion (DEI) and LGBTQ health initiatives.

The ruling, issued from the bench by U.S. District Judge William G. Young, labeled the NIH's actions as “palpable” racial and LGBTQ discrimination, saying he had “never seen anything like this” in his four decades on the bench.

“This represents racial discrimination and discrimination against America’s LGBTQ community. That’s what this is,” Judge Young declared in open court. “I would be blind not to call it out.”

Grants Axed Without Evidence, Judge Says

At the heart of the dispute are hundreds of cancellation letters sent by NIH in March—terminating funding for programs tied to vaccines, transgender health, DEI, pandemic response, and environmental research. According to the judge, those letters were devoid of supporting evidence, amounting to little more than ipse dixit—a Latin phrase meaning “because I said so.”

“Looking at these letters… there’s no support,” Judge Young said. “They’re just conclusory statements.”

The judge's dramatic oral ruling—delivered ahead of a forthcoming written opinion—allows the federal government to immediately appeal the injunction.

Economic Fallout: Universities Sound the Alarm

The legal battle, triggered by a 16-state coalition and later joined by the American Public Health Association, alleges that NIH's cuts violate the Administrative Procedure Act, the Public Health Service Act, and constitutional separation of powers.

The impact has been swift and severe:

• University of Massachusetts was forced to cancel graduate scholarships.

• University of Washington warned it may lay off or furlough staff due to 73 endangered grants worth $61 million.

Massachusetts Deputy Solicitor Gerard Cedrone argued the cuts clearly undermine congressional mandates to improve health outcomes for underrepresented groups.

“It’s hard to see how this aligns with the Public Health Service Act,” Cedrone told the court, “which requires thoughtful advancement of minority, women’s, and LGBTQ health.”

DOJ Defense Meets Fiery Skepticism

Thomas Ports, representing the U.S. Department of Justice, contended that DEI-based grants were canceled for relying on “nonscientific” criteria and potentially supporting unlawful bias. But Judge Young demanded proof.

“Point me to anywhere in this record… where these grants support unlawful discrimination,” Young challenged.

Ports' response: “There’s nothing I can point the court to.”

Parallel Lawsuit Over Indirect Costs Also in Play

This is not NIH’s only courtroom skirmish. A separate lawsuit—filed in February and led by 22 states—challenges NIH’s move to cap indirect research costs at 15%, a cut expected to save $4 billion but potentially gut university funding for labs, utilities, and equipment.

In that case, another Massachusetts judge also blocked the cuts, with the federal government currently appealing to the First Circuit.

With legal pressure mounting, federal agencies including HHS and the White House declined to comment on the ongoing litigation. Meanwhile, the fate of billions in research funding now hinges on further court rulings and a fast-moving appeals process.
