KJ Biermann, the 15-year-old son of “Real Housewives of Atlanta” alum Kim Zolciak and former NFL player Kroy Biermann, appeared in Fulton County Superior Court Friday as prosecutors disclosed previously unreported allegations involving the teenager.

During the hearing, Deputy District Attorney Caitlin McGillicuddy told Judge Melynee Leftridge that investigators had allegedly discovered videos on KJ’s cellphone depicting sexual activity involving a family member who was under 12 years old at the time. According to the prosecutor, investigators found multiple videos that allegedly showed sexual encounters and included what she characterized as “predatory, derogatory” language.

Prosecutors Reveal KJ Biermann Has New Allegations

The allegations were presented during a bond hearing in connection with an existing criminal case against KJ. The teenager has not been convicted of the charges, and his attorney strongly disputed the prosecution’s characterization of an earlier juvenile matter.

McGillicuddy said the newly disclosed allegations represented a second serious sexual-related matter involving female victims. She also said KJ had previously been charged with sexual battery involving a victim under 16, a matter that had not previously been publicly reported.

Investigators found videos on KJ’s cellphone allegedly depicting sex with a family member under the age of 12. 

The prosecutor detailed “multiple encounters” on video. And there are also videos that show KJ  using “predatory, derogatory” language toward the victim.

Defense Disputes Characterization of the First Case

KJ’s attorney, Jason Sheffield, challenged the prosecutor’s description of the earlier juvenile case.

He said the previous case involved inappropriate behavior between two middle-school students and did not result in an adjudication for statutory rape, sexual intercourse or a comparable offense.

The dispute over the earlier case is separate from the current felony allegations, which stem from an alleged April incident involving a female classmate.

Seven Felony Charges Against Teenager

A Fulton County grand jury indicted KJ on Sept. 3 on seven felony charges. The indictment includes aggravated child molestation, aggravated sexual battery, aggravated sodomy, three counts of aggravated sexual battery against a child under 16 and false imprisonment.

The current case reportedly stems from an alleged April 23 incident involving a 15-year-old girl who described herself as the best friend of KJ’s girlfriend. According to court documents cited by Page Six, the girl accused KJ, who was 14 at the time, of sexually assaulting her at a Life Time Fitness facility in Alpharetta, Georgia.

KJ was arrested Aug. 17 and taken to the Metro Regional Youth Detention Center in Atlanta, where he remained in custody without bond pending the court proceedings.

The allegations remain accusations, and KJ is presumed innocent unless proven guilty in court.

Prosecutors Seek High Bond

During Friday’s hearing, Sheffield requested that KJ be released on a $65,000 bond. He described the teenager as quiet and argued that the case had been personally traumatizing for his client.

Sheffield also pointed to KJ’s accomplishments in school, the community and football. He proposed that Zolciak supervise her son if he were released.

Prosecutors opposed the request. McGillicuddy cited what she described as documented physical injuries suffered by the alleged victim and characterized the underlying incident as predatory.

The prosecutor requested a $190,000 bond.

The alleged victim also submitted a statement that was read in court. She asked the judge to consider her safety before making a decision about KJ's release.

According to the statement, the girl said she was living in fear because of alleged threats that KJ would retaliate against her if released. She also said members of her family had received phone calls and emails related to the situation.

The prosecutor said the alleged threats added to concerns about releasing KJ.

Judge Considers Whether KJ Biermann Will Be Released

Judge Leftridge was expected to determine whether KJ would be released on bond following the hearing. The teenager's parents attended the proceedings, along with his 29-year-old sister, Brielle Biermann.

Zolciak and Kroy Biermann have publicly supported their son during the legal proceedings. Zolciak previously criticized what she called “reckless and deeply troubling” accusations against KJ.

Kroy and Zolciak also share children Kash Biermann, 14, and 12-year-old twins Kane and Kaia. Kroy previously adopted Zolciak’s older daughters, Brielle and Ariana Biermann.

Brielle has continued preparations for her planned November wedding despite the legal circumstances surrounding her younger brother.

KJ Biermann Could Be Tried in Juvenile Court

The case's jurisdiction could become another significant legal issue.

Following the cancellation of an earlier hearing, Sheffield filed a motion seeking to transfer the proceedings to Fulton County Juvenile Court and keep the proceedings confidential.

In court filings, Sheffield argued that KJ is an adolescent whose development is ongoing. He also noted that the aggravated charges could carry a mandatory minimum sentence of 25 years in prison without the possibility of parole if the case were ultimately handled under the applicable adult criminal provisions.

Whether KJ will face the case in juvenile or adult court remains an important issue for the defense.

Kroy Biermann Faces Separate Financial Judgment

The legal proceedings involving KJ are occurring as his father faces a separate financial matter.

Kroy was ordered to pay approximately $64,000 stemming from a gambling-related debt associated with a 2021 trip to the Bahamas. According to court documents reported by Us Weekly, Sky Warrior, which handles credit lines at the Baha Mar Casino, obtained a judgment for $52,500, along with prejudgment interest and $11,927.35 in attorney fees and costs.

The financial judgment is unrelated to the criminal allegations against KJ.
