Lying to Congress: Two Former FBI Officials Charged Over Hunter Biden Laptop Investigation

lying to congress

WASHINGTON — Lying to Congress is at the center of a politically sensitive criminal case involving two former senior FBI officials accused of making false statements about their knowledge of the bureau’s investigations into Hunter Biden and his laptop. The charges against former FBI intelligence official Nikki Floris and former Counterintelligence Division deputy assistant director Bradley Benavides raise questions about the FBI’s handling of politically sensitive information, congressional oversight and the timing of criminal prosecutions.

According to a criminal complaint unsealed Friday in federal court in Washington, D.C., Floris, 46, and Benavides, 56, each face one count alleging they lied to Congress about their involvement in the FBI’s Foreign Influence Task Force and its work related to Hunter Biden during the 2020 presidential election.

The allegations concern testimony given in 2023, more than three years before the charges were filed. Both defendants have challenged the accusations, and the allegations have not been proven in court.

What the Charges Allege

The complaint alleges that Floris made false statements during a July 19, 2023, interview with the House Judiciary Committee, while Benavides allegedly made false statements during congressional questioning in September of that year.

Investigators say the former officials were more involved in the Hunter Biden investigations than their testimony suggested. The complaint cites witness accounts, internal documents and communications dating from December 2019 through September 2021 that allegedly show both officials had knowledge of the investigations and participated in related briefings.

Floris reportedly denied having any involvement in the Hunter Biden investigation when asked directly by lawmakers. She also said she was unaware of discussions about Hunter Biden within the Foreign Influence Task Force.

Hunter Biden Laptop Contents Concealed

Benavides, meanwhile, allegedly told congressional investigators that he learned details about the laptop investigation from Wikipedia while preparing for his testimony. When asked whether he had known about the matter during his FBI tenure, he reportedly answered no.

The complaint cites a congressional staff member who attended both interviews and later characterized the officials’ testimony as materially untrue. An FBI employee also reportedly told investigators that he had discussed the laptop and its contents with Benavides.

Prosecutors allege the statements were intended to conceal the task force’s communications and involvement in the investigations and impede congressional scrutiny.

The Hunter Biden Laptop Found in 2019

The case stems in part from the controversy surrounding a laptop that Hunter Biden, the son of former President Joe Biden, reportedly left at a Delaware computer repair shop in 2019.

Copies of data attributed to the laptop later became central to political and media disputes over Hunter Biden’s foreign business dealings, his family connections and the handling of information potentially relevant to federal investigations.

The material publicly reported from the laptop included emails, business records, photographs, personal correspondence and other files. Some communications appeared to document Hunter Biden’s professional relationships and dealings involving overseas business interests, including Ukraine-based energy company Burisma Holdings, where he served on the board.

Laptop Issue in 2020 Election

The laptop became a major political issue in the run-up to the 2020 presidential election. Questions arose over the authenticity and provenance of the data, how the FBI assessed potential foreign influence and whether officials or media organizations had adequately informed the public about the material.

The existence of authentic files from the laptop was subsequently corroborated through reporting and forensic examinations, although individual files and claims drawn from the data have required separate verification. The presence of material on a device does not, by itself, establish that every allegation associated with it is true.

The criminal case against Floris and Benavides concerns their alleged statements to Congress about the FBI’s work, not a direct prosecution over the laptop’s contents.

Hunter Biden’s Federal Investigations

Hunter Biden faced separate federal investigations into his tax affairs, firearm purchase and overseas business activities. Former Attorney General Merrick Garland appointed a special counsel to oversee the federal investigations.

In 2024, a federal jury convicted Hunter Biden on three felony firearm charges connected to his purchase of a gun while, according to the prosecution, unlawfully using drugs. In a separate federal tax case, he pleaded guilty to three felony tax offenses and six misdemeanor tax offenses.

Before leaving office in December 2024, President Joe Biden issued a broad pardon for his son covering federal offenses committed or potentially committed during a specified period from January 2014 through December 2024. The pardon prevented further federal punishment for covered conduct.

Despite scrutiny of Hunter Biden’s foreign business dealings, he was not charged in connection with the allegations involving his overseas business relationships described in the supplied account.

Foreign Influence Task Force Under Scrutiny

The complaint also focuses on an FBI counterintelligence operation known as “Round River,” which allegedly involved collecting and assessing informant reporting concerning Hunter Biden and evaluating whether the information might be Russian disinformation.

According to the filing, Floris and Benavides held supervisory roles within the Foreign Influence Task Force during the period surrounding the 2020 election. The complaint alleges they participated in classified briefings for agents and prosecutors working on the Hunter Biden investigations.

It also alleges that both officials reviewed or approved materials connected to defensive briefings for Republican senators Charles Grassley and Ron Johnson on Aug. 6, 2020. Such briefings are intended to warn individuals when foreign actors may be attempting to influence them or when information about them may be connected to a foreign influence operation.

The allegations raise questions about how the FBI distinguished legitimate investigative information from potential foreign disinformation during a highly contentious election cycle.

Defense Attorneys Challenge Timing of Charges

The timing of the case drew immediate criticism from defense attorneys and scrutiny from Magistrate Judge Zia Faruqui, who presided over the defendants’ initial court appearance.

Benavides’ attorney, Ron Safer, argued that the government had possessed the relevant information for years and asked the court to schedule a preliminary hearing quickly to examine whether probable cause supported the charge.

Faruqui described the way the case had been brought as unusual and rejected prosecutors’ request for a delay of two weeks or longer. He ordered the parties to return to court Tuesday.

Floris’ attorneys also denied the allegations and criticized the timing, arguing that the charges were politically motivated because they were brought shortly before the midterm election.

Prosecutors maintain that the complaint sets out evidence supporting the charges. The defense positions, however, underscore that the allegations remain contested and must be evaluated through the judicial process.

A Politically Sensitive Test for the Justice Department

The prosecution comes amid continuing disputes over the Justice Department’s handling of cases involving prominent political figures and former federal officials. The complaint’s allegations, the years between the congressional testimony and the charges, and the approaching election are likely to intensify public scrutiny.

The case also highlights the distinction between criminal liability for allegedly false statements and disagreements over how an investigation was conducted. Congressional testimony can carry criminal consequences when officials knowingly make materially false statements, but prosecutors must still establish the required elements of the offense.

For now, Floris and Benavides face allegations rather than convictions. The court proceedings will determine whether the evidence supports the charges and whether the government can prove its claims beyond a reasonable doubt if the case proceeds to trial.
