MV Realty “Real Estate Scam” Case in Florida Final Judgment, Lifts Liens from Thousands of Homes

Florida officials announced a decisive legal victory this week in the long-running MV Realty real estate scam case, confirming that thousands of homeowners across Florida are finally free from decades-long contracts that state prosecutors said were designed to strip equity from financially vulnerable residents. 

Florida Attorney General James Uthmeier confirmed a final judgment against MV Realty, formally bringing to a close what the state described as a deceptive and unconscionable business model.

The ruling dismantles the controversial program that had placed liens on more than 9,300 Florida properties, forcing MV Realty to remove those encumbrances while paying millions in penalties. State leaders say the outcome sends a clear message about predatory practices in the real estate industry.

Florida Attorney General Declares Victory Over MV Realty

Attorney General James Uthmeier did not mince words when announcing the resolution of the MV Realty real estate scam case in Florida.

“MV Realty scammed thousands of Florida homeowners, and now justice has prevailed,” Uthmeier said. “This massive legal win set the standard for other states looking to move forward with similar investigations and lawsuits against these scammers.”

Under the judgment, MV Realty must pay $3 million by June 30, 2026. If the company fails to do so, Florida is authorized to pursue the full suspended judgment of $18 million.

More importantly for homeowners, the ruling immediately clears the titles of thousands of affected properties across the state.

MV Realty “Benefit” Was a Burden

At the center of the Florida case against MV Realty was the company’s so-called Homeowner Benefit Agreement. The program was marketed as a simple way for homeowners to receive fast cash, often a few hundred or thousand dollars, with assurances that the money never had to be repaid.

In exchange, homeowners agreed to use MV Realty as their exclusive listing agent if they ever sold their home.

State prosecutors argued that the true cost of the agreement was buried deep in the fine print. The contracts effectively created a 40-year lien on the property. Homeowners who tried to sell with another agent, refinance, or transfer property to heirs faced a penalty equal to 3% of the home’s value.

According to the Attorney General’s office, MV Realty even collected fees when homes went into foreclosure—despite never providing real estate services in many cases. In February 2025, a court ruled the business model was “unconscionable.”

Real Estate Scam Cleaned up for Florida Homeowners

The final judgment lays out strict requirements for MV Realty and its leadership, including principals Antony Mitchell, Amanda Zachman, and David Manchester.

Key provisions include:

  • Immediate Relief: Termination and removal of all liens tied to the Homeowner Benefit Agreements from Florida public records.
  • Financial Penalties: An $18 million suspended judgment, including $6 million in ill-gotten gains and $10 million in civil penalties, satisfied by a $3 million payment if conditions are met.
  • Business Bans: A 10-year prohibition on the principals creating assets secured by residential property in Florida or running consumer-facing telemarketing businesses in the state.

Uthmeier credited the outcome to the work of his Consumer Protection team, led by Special Counsel Ellen Lyons, and said the judgment could serve as a roadmap for other states reviewing similar long-term real estate contracts.

A Blueprint for Other States

Consumer advocates say the MV Realty real estate scam ruling in Florida could have national implications, as regulators elsewhere continue to scrutinize unconventional real estate listing agreements.

For affected homeowners, however, the impact is immediate and personal: their property titles are finally free from what MV misleadingly called  “Homeowner Benefits."
