OSHA Wants Overdose Reversal Kits at Work, But Stops Short of a Mandate

Inside OSHA's Overdose Playbook for Employers

  • OSHA wants naloxone kept where workers can grab it fast, like a first aid kit.
  • The guidance is voluntary, but it sets a benchmark employers may be measured against.
  • Reversal drugs buy time. Calling 911 is still step one.

Federal regulators want overdose reversal drugs treated like a first aid kit. On September 24, 2026, OSHA released a fact sheet titled Opioid Overdose Rescue with Reversal Medications, urging employers to keep FDA-approved drugs such as naloxone or nalmefene on hand. The fact sheet is part of the Great American Recovery Initiative, a government-wide push by the Trump administration on addiction treatment and recovery. OSHA

The advice gets practical fast. OSHA wants overdose kits stored in highly visible, easy-to-reach spots, the way employers already handle first aid supplies. It also compares them to automated external defibrillators. Workers should learn the warning signs: breathing that slows or stops, bluish lips or skin, pinpoint pupils, no response at all. They should also be trained in how to give the medication safely. One point matters most. Even with naloxone in hand, responders should call 911 right away. The drug buys minutes. It doesn't replace a paramedic. New Guidance for Opioid Emergencies

Now the catch. The guidance asks. It doesn't order. According to the law firm Littler, the fact sheet expressly declines to create new OSHA requirements under the Medical Services and First Aid standard or the recordkeeping rules. Employers in states that run their own OSHA programs should check state law for added duties, and Littler advises consulting workplace safety counsel before acting. This isn't the first federal word on the subject either. NIOSH has published its own naloxone guidance for employers.

Voluntary doesn't mean ignorable, though. That's our read, not OSHA's. Plaintiffs' attorneys often point to agency guidance when they argue what a reasonable employer should have known. A federal fact sheet comparing naloxone kits to first aid equipment gives them something concrete to hold up. Whether a court accepts that argument depends on the facts and the state. But employers weighing the cost of a kit and a training session should also weigh what it looks like to have done nothing after September 24. Risk managers and insurance carriers will likely be reading closely too.

The numbers explain the urgency. The CDC counted 44,564 opioid-related overdose deaths in the United States in 2025. Some reports suggest nearly 20 percent of workers use a substance of some kind, a figure that covers substances broadly, not just opioids. White House drug czar Sara Carter said fentanyl has saturated the illicit drug supply, making it critical for American workers to know how to recognize and reverse an overdose. hrdive

The timing matters too. The guidance landed during National Suicide Prevention Month, and opioids are sometimes involved in suicide attempts. That widens the picture. An overdose at work isn't always what people imagine, and the person in trouble may be someone nobody knew was struggling. Anyone in crisis can call or text 988.

Stocking a kit is the easy part. The harder test comes when a coworker stops breathing and everyone in the room is waiting for someone else to know what to do.
