In a legal battle that put labor rights under the microscope, a Georgia-based children’s therapy provider, Summit Therapeutics LLC, has agreed to pay approximately $127,000 to settle allegations of unpaid wages. The settlement aims to resolve a collective action lawsuit accusing the company of failing to compensate registered behavior technicians (RBTs) for essential pre- and post-appointment tasks, including administrative duties and other off-the-clock work.

A Deal Struck in Federal Court

The lawsuit, lodged in Georgia federal court, took a significant turn on Friday when Summit Therapeutics, along with three of its top executives, announced the settlement agreement to end the legal skirmish. The case revolved around claims that the company had violated the Fair Labor Standards Act (FLSA) by denying technicians rightful wages for all hours worked.

Breaking Down the Settlement

According to court filings, the settlement dictates that the affected workers will collectively receive nearly $69,000—a sum that includes unpaid wages and liquidated damages. Meanwhile, the attorneys representing the workers will pocket almost $59,000 in legal fees.

The Allegations: Workers Speak Out

The lawsuit was initially filed in July by former employees Brittany Wiley, Candice McCall, Kathryn Wilson, and Ashley Glore. These applied behavior analysis (ABA) therapy providers alleged that they diligently worked with children and their families, tailoring therapeutic approaches to each child’s needs and progress. However, the plaintiffs argued they were only compensated for direct, billable client services and were not properly paid minimum wage or overtime for additional hours worked.

Certification and Settlement

The case gained traction in September when the court conditionally certified a collective action comprising registered behavior technicians. The certification paved the way for a broader workforce to join the legal battle against Summit Therapeutics, ultimately leading to the negotiated resolution.
