Trump, Bondi TikTok assets sale suit

A newly formed anti-corruption organization has launched a legal challenge that is already sending shockwaves through Washington. The Trump, Bondi TikTok assets sale suit accuses President Donald Trump and Attorney General Pam Bondi of sidestepping federal law when approving the sale of TikTok’s U.S. assets to investors with ties to the White House.

The lawsuit, filed in federal court in Washington, D.C., claims the administration ignored legislation intended to curb potential Chinese propaganda and data risks. Instead, according to the complaint, the White House helped facilitate a partial sale of the popular social media platform to a group of politically connected businessmen.

Lawsuit Accuses Administration of Defying Congress

At the center of the dispute is the claim that the Trump administration disregarded a law passed by Congress aimed at forcing TikTok’s Chinese parent company, ByteDance, to relinquish control of its U.S. operations.

Brendan Ballou, chief executive of the newly launched nonpartisan organization The Public Integrity Project, said the legal action is designed to test whether the executive branch can simply brush aside congressional mandates.

“By flaunting the law so publicly, I think the president is trying to send a message that he is quite literally beyond the reach of the courts, beyond the reach of Congress, beyond the reach of the rule of law,” Ballou said. “And we want to make sure that he isn’t.”

The White House did not immediately respond to requests for comment, while the Justice Department declined to discuss the matter.

Law Meant to Counter Chinese Influence

The controversy traces back to legislation passed by Congress two years ago, aimed at addressing national security concerns tied to TikTok. Lawmakers from both parties feared the Chinese government could exploit the app either to harvest data from millions of American users or to spread propaganda.

While no public evidence has proven such activity occurred, national security experts have long warned that the possibility remains credible given Beijing’s influence over Chinese companies.

The law required ByteDance to divest control of TikTok’s U.S. operations to investors outside China, allowing only one extension before enforcement.

However, according to the lawsuit, President Trump granted five separate extensions instead.

Supreme Court Ruling and DOJ Decision

ByteDance challenged the legislation, arguing it violated the free speech rights of both the company and its massive user base. After an emergency hearing last year, the U.S. Supreme Court unanimously upheld the law.

Soon afterward, Trump reportedly directed Attorney General Pam Bondi not to enforce the statute, including a requirement for the Justice Department to conduct investigations. The DOJ took no public action, a move the lawsuit calls an ongoing violation of federal law.

Controversial Sale of TikTok’s U.S. Assets

In January, Trump approved a deal allowing a group of companies and investors to purchase TikTok’s U.S. assets. Some of those investors had reportedly helped raise funds for Trump’s political campaign or invested in businesses connected to his family.

The investment group includes technology giant Oracle, Abu Dhabi’s MGX, Susquehanna International Group, and private equity firm General Atlantic.

Trump celebrated the transaction publicly, writing on social media that he was “so happy” to have helped save TikTok and praising what he described as the “very dramatic, final, and beautiful conclusion” to the negotiations.

Yet critics say the deal left crucial elements of TikTok’s operations under Chinese control.

Algorithm and Operations Remain With ByteDance

According to the complaint, ByteDance continues to own TikTok’s core recommendation algorithm — the powerful software engine that determines which videos appear in users’ feeds.

The Chinese company would also continue managing several operational aspects of the platform within the United States, which the lawsuit argues violates the intent of the 2024 law requiring a complete divestiture.

Investors Claim Financial Harm

The plaintiffs include two technology investors who say the government’s failure to enforce the law directly harmed them.

One plaintiff, Zhaocheng Anthony Tan, is a software engineer who owns shares in Alphabet Inc., the parent company of Google. The second, Garrett Reid, is a software engineer who owns stock in Meta Platforms Inc.

Both companies compete with TikTok and were expected to benefit if the law forced the platform into major restructuring or a full sale.

Instead, the investors argue that the administration’s actions preserved TikTok’s dominance in the U.S. social media market.

Justice Department Turmoil Adds Context

The lawsuit arrives amid broader upheaval inside the Justice Department. Over the past year, leadership changes have significantly reduced the size and scope of key units responsible for investigating public corruption and tax-related crimes.

Officials have also dismantled a task force previously dedicated to combating international corruption.

Ballou, a former Justice Department attorney, said his organization hopes to fill that void.

“Right now, the basic infrastructure for prosecuting white-collar crime is being dismantled at the Department of Justice,” he said. “In a world where DOJ is no longer particularly interested in going after rich criminals, we want to rebuild some of that infrastructure outside the government.”

As the Trump, Bondi TikTok assets sale suit moves forward, the case could become a defining legal test of executive power, congressional authority, and the future of one of the world’s most influential social media platforms.
