Trump Pardons Convicted Insider Trader and Former Congressman Stephen Buyer

The ink was barely dry on the June 4th proclamation before Washington exploded. President Donald J. Trump, invoking the full weight of Article II of the Constitution, granted a full, complete, and unconditional pardon to former Indiana Republican Congressman Stephen E. Buyer — a man a federal jury convicted of insider trading, and a man the Southern District of New York sent to prison for 22 months.

Buyer was sentenced in September 2023 on four counts of securities fraud tied to two separate insider trading schemes he executed in 2018 and 2019 — years after he left Congress to work as a private corporate consultant. A New York jury found him guilty of trading on inside information he received as a consultant to T-Mobile ahead of its $23 billion merger with Sprint, buying Sprint stock after learning from a T-Mobile executive that the deal was in motion.

THE PARDON: 50+ GOP ENDORSERS LINED UP

What makes this story even more extraordinary is the sheer volume of Republican firepower that rallied behind Buyer's pardon request. The White House proclamation lists over 50 current and former GOP officials who gave their "complete and total endorsement" — a who's who of Republican Washington spanning three decades.

Signatories asked Trump to pardon Buyer's criminal conviction and also direct the DOJ to dismiss a related SEC civil case, pointing to Buyer's loyalty — including his service on Trump's 2016 Presidential Transition Team. Buyer served in the House from 1993 to 2011 and attained the rank of colonel in the Army JAG Corps. Washington Times

Among those endorsing the pardon: former House Speaker John Boehner, former Senate Armed Services Committee Chair Roger Wicker, Lindsey Graham, Tom DeLay, Rick Santorum, Ileana Ros-Lehtinen, and Bob Livingston — names that defined the Republican Party for a generation. Current members of Congress including Jack Bergman, Ken Calvert, Tom Cole, Pete Sessions, and Marlin Stutzman also signed on.

THE CONVICTION

According to the Department of Justice, Buyer "engaged in two separate, but interrelated insider trading schemes to steal material non-public information that he obtained through consulting work and to place timely, profitable securities trades based on that stolen information." 

He was indicted for allegedly using inside information to buy $1.5 million in stocks. This wasn't a technical violation buried in regulatory fine print. This was a former Member of Congress — a man entrusted with classified briefings, corporate access, and the credibility of federal office — allegedly using that access to enrich himself on Wall Street while ordinary investors traded blind. Fortune

He was found guilty at trial, sentenced by U.S. District Judge Richard M. Berman on September 19, 2023, after which U.S. Attorney Damian Williams declared: "Stephen Buyer was convicted by a jury of twice engaging in insider trading... He abused positions of trust for illicit personal gain, and today he faced justice for those acts." Yahoo!

Buyer served 22 months and was released in February 2025. He had already completed his sentence when Trump signed the pardon proclamation. So, this isn't about compassionate release. This is about something else entirely — the erasure of the record itself. 

THE ARGUMENT FOR THE PARDON

To be fair, and the USA Herald is always fair, supporters of the pardon make substantive arguments that deserve to be heard.

Advocates claim prosecutors relied on circumstantial evidence and that Buyer was convicted by what they characterized as a Democrat jury and judge. Pardon supporters argued the SEC and DOJ were "weaponized against Congressman Buyer as political retribution" and that he was "prosecuted in criminal and civil courts without any direct evidence by testimony or document." 

The proclamation itself highlights Buyer's decorated military career — his service as a Judge Advocate General in the United States Army, his 18 years representing Indiana in the House, his role on the Veterans Affairs Committee, and his participation in the impeachment of President Bill Clinton in the 1990s.

These are real accomplishments. The question is whether they constitute a legal or moral basis to nullify a jury verdict?

Whether that is justice restored or justice reversed depends on who you ask.
