While the panel acknowledged that Research Corporation Technologies might have arguments related to alleged unauthorized use of the yeast system, those claims were outside the scope of the appeal. The ruling focused solely on the royalty payment dispute.
The decision reversed the 2021 order issued by U.S. District Judge Scott H. Rash, who had previously required Eli Lilly to compensate Research Corporation Technologies based on a broader interpretation of the licensing agreement.
Legal representatives for both parties did not immediately provide public comment following the ruling.
The appellate panel included Judges Daniel P. Collins, Salvador Mendoza Jr., and Roopali H. Desai of the Ninth Circuit.
The case is Research Corporation Technologies Inc. v. Eli Lilly and Company, heard under case number 24-4786 in the Ninth Circuit Court of Appeals.
