Why WhatsApp’s Privacy Policy Is Under Legal Fire in India

A major legal showdown is unfolding in India over WhatsApp and its 2021 privacy policy update — a case that could reshape how global technology companies handle user data in one of the world’s largest digital markets.

At the heart of the dispute are questions about privacy rights, consumer choice, and whether dominant tech platforms can require users to share data as a condition for accessing essential services.

What Triggered the Controversy?

In January 2021, WhatsApp introduced a revised privacy policy requiring Indian users to accept expanded data-sharing practices with its parent company, Meta Platforms, in order to continue using the app. Critics described the approach as “take it or leave it,” arguing that users were effectively forced to agree if they wanted to remain on the platform.

India’s top competition regulator, the Competition Commission of India, launched an investigation in March 2021. The watchdog alleged that WhatsApp was exploiting its dominant market position and limiting user choice by mandating data-sharing terms.
