“The factors that led Judge Nichols to issue the original stay of sentence were still in effect,” Bannon argued. “This is emphatically so when the four months sentence imposed would have run its course by the time the appeals process runs its course, causing irreparable harm if and when the judgment is reversed by one of those courts competent to consider the issues on the merits.”
