Legal Remedies Sought
Klein seeks several forms of injunctive relief, including:
- Requiring Microsoft to continue Windows 10 support without additional fees until the operating system falls below 10% of total Windows users
- Mandating clear disclosures about end-of-support dates and consequences at the point of purchase
- Relaxing Windows 11 hardware requirements to allow existing Windows 10 devices to upgrade
- Providing Extended Security Updates without additional charges
The lawsuit also requests that Microsoft’s advertising practices be reformed to include transparent information about software lifecycle limitations and security implications.
Microsoft’s Market Position
The complaint notes that Microsoft’s strategy appears to be financially successful, with the company reaching “a record high stock price of $490.11” as of June 24, 2025, and achieving a market capitalization of $3.896 trillion.
Klein’s legal team points to Microsoft’s own promotional materials as evidence of the company’s intent. The lawsuit quotes a June 2025 full-screen advertisement stating: “With support for Windows 10 ending on October 14, 2025, rest assured we have you covered.… Level up to the new Copilot+PCs.”
