KemperSports Faces Rising Legal Battles Over Data Breach

According to the complaint, Campe was informed of the breach on September 9 and now faces the risk of identity theft. He has spent significant time monitoring his accounts and setting up credit alerts as a result.

“Because of the data breach, plaintiff spent time dealing with the consequences, including verifying the legitimacy of the notice and self-monitoring his accounts to ensure no fraudulent activity occurred. This time has been lost forever and cannot be recaptured,” the lawsuit stated.

Campe’s claims include negligence, breach of implied contract, and unjust enrichment. Another proposed class action was filed earlier this week by Kansas resident Kendra Davila, making similar allegations.

Previous and Dismissed Cases

Former KemperSports employee Kelli Seals filed her own proposed class action in September. On the same day, a separate lawsuit by Rachel Getzinger was dismissed by U.S. District Judge Joan B. Gottschall, who ruled that Getzinger’s complaint did not adequately establish the court’s jurisdiction. However, this dismissal was without prejudice, meaning it could be refiled.
