“Despite its decision not to license the Scalr Software for the calendar year 2024, UnitedLex has continued to make the Scalr Software available to its customers, and UnitedLex and its law firm clients thus far continue to use the Scalr Software into 2024,” Wednesday’s filing states.
Claims of Unauthorized Software Use
Scalr claims that throughout 2024, UnitedLex has unlawfully used its software, employing operating systems, deploying the software to clouds, permitting users to log in, and managing endpoints. “By intentionally using the Scalr Software without a license, UnitedLex has knowingly violated, and continues to knowingly violate, Scalr’s copyrights,” the company alleges.
Scalr also mentions contacting UnitedLex with a demand letter regarding the unpaid license fees for overuse in 2023 and its alleged ongoing use of the software.
