However, Chief Justice Roberts rejected this argument, stating that the tribes’ flexibility in using the funds is a fundamental aspect of ISDA, designed to allow them to tailor healthcare programs to their communities’ specific needs.

Justice Brett Kavanaugh, along with the three other conservative justices, dissented. He argued that the ruling disrupts 30 years of practice and suggested that Congress could have addressed the issue but chose not to.

It not only acknowledges the historical underfunding but also paves the way for improved healthcare services on reservations. This decision underscores the importance of tribal sovereignty and the federal government’s obligation to uphold its commitments.
