Despite the lack of evidence and inconsistencies in the accuser’s story, Winters’ mugshot and charges were plastered all over the media. She was also strip searched and forbidden from being in contact with minors.
During the trial, Deputy Roque admitted that he had not properly investigated the allegations against Winters, failed to interview key witnesses, and had not checked alibis for the teacher. Winters testified that Roque’s malicious indifference to her rights had ruined her life.
Winter’s attorney Thomas K. Plofchan said that the jury’s decision is a victory for Winters and a reminder of the need to hold law enforcement accountable for her wrongful arrest. He also noted that law enforcement has great power and responsibility. Reckless charges can ruin reputations and destroy lives.
While the $5 million award is a significant sum, Winters notes that it is not a cure-all.
