Boeing Settles Ethiopian 737 Max Case

In a dramatic turn of events just before opening arguments were set to launch in federal court, Boeing has quietly settled two high-profile wrongful death lawsuits tied to the catastrophic crash of Ethiopian Airlines Flight 302, involving its controversial 737 Max aircraft.

The aerospace giant reached confidential agreements with the families of Antoine Lewis, a U.S. Army captain, and Darcy Belanger, a Canadian environmental advocate, both victims aboard the ill-fated flight. The settlements emerged mere hours before a scheduled damages trial in Chicago federal court was poised to commence Monday, marking what would have been the first jury trial in this sprawling litigation.

Two Lives, Two Legacies — Cut Short by Catastrophe

Antoine Lewis had been on military leave, seizing a rare opportunity to travel across Africa. He leaves behind his wife, fellow soldier Yalena Lopez-Lewis, and their two young sons. Darcy Belanger was en route to speak at a United Nations Environment Assembly when the tragedy unfolded. His legacy endures through his wife, Amie, and his parents.

“These resolutions don’t bring our heroes back,” said Robert Clifford, lead counsel in the multidistrict Ethiopian Airlines litigation, “but they represent the first step toward closure for families who've carried grief like armor for far too long.” Clifford emphasized that the legal campaign continues, with more trials lined up — the next starting July 14, and another set for November 3.

Legal Skirmishes in the Shadows of Grief

Attorney Mark Lindquist, who represented Belanger’s family, praised the outcome, noting his client’s perseverance. “She stood her ground,” he said. “This resolution provides the accountability and closure we fought for.”

Antonio Romanucci, representing the Lewis family, echoed similar sentiments, stating that while the deal helps close a painful chapter, “it can never replace the towering loss they now live with daily.”

While Boeing has managed to resolve multiple claims before reaching a jury, legal pressure continues to mount. U.S. District Judge Jorge Alonso noted the significance of the timing, saying the cases had moved “closer to trial than ever before.”

A Tragedy Born from Hubris and Flawed Tech

The crash of Flight 302 in March 2019 was Boeing’s second in five months involving its newly minted 737 Max jet. The first, Lion Air Flight 610, plunged into the Java Sea, killing 189 people. Both disasters were ultimately linked to a flawed automated control system known as MCAS (Maneuvering Characteristics Augmentation System) — a technology that investigators later found was vulnerable to faulty sensor data and prone to forcing the nose of the plane downward, even against pilot input.

Critics have lambasted Boeing for placing profits over safety, alleging the company rushed the Max’s development, cutting regulatory corners to compete with Airbus in a high-stakes commercial aviation race.

Settlements Without a Spotlight

In November 2021, Boeing accepted responsibility for the Ethiopian Airlines crash, allowing victims' families to pursue compensatory damages under Illinois law — including claims for emotional distress, economic loss, and pain and suffering. However, they relinquished the right to pursue punitive damages under that agreement.

“Boeing’s liability was never in question,” said Clifford, “but justice isn't measured in dollars. It's measured in truth and accountability.”

Boeing, for its part, issued a public statement expressing remorse. “We are deeply sorry to all who lost loved ones on Lion Air Flight 610 and Ethiopian Airlines Flight 302,” the company said Monday. “We remain committed to fairly compensating families and taking full legal responsibility for the accidents.”

A Legal and Emotional Marathon

Legal representation for the families includes top-tier litigation teams from Clifford Law Offices, Romanucci & Blandin, Mark Lindquist Law, and BartlettChen LLC. Boeing’s defense has been mounted by powerhouse firms Winston & Strawn LLP and Perkins Coie LLP.

As Boeing continues to navigate a storm of legal and reputational fallout, the latest settlements send a clear message: while the courtroom battles may be staggered, the pursuit of justice for the 737 Max’s victims is far from grounded.
