DOJ Sues Silicon Valley’s Cloudera Over Alleged Scheme To Exclude U.S. Workers From High-Paying Tech Jobs In Favor of Foreign Visa Hires

The Scheme: A Dead-End Email Address, a Rigged Process

Let me be direct with you, because that's what you come to the USA Herald for. This isn't a bureaucratic snafu. This isn't an HR mistake buried in a policy manual. What the Justice Department is alleging is deliberate. Calculated. And frankly, infuriating.

According to a federal complaint filed today, April 28, 2026, Cloudera Inc. — a Silicon Valley tech company headquartered in Santa Clara, California — allegedly created a completely separate recruitment and hiring process designed specifically to deter American workers from even bothering to apply for lucrative technology positions the company had already earmarked for foreign workers holding temporary employment visas.

Here's the kicker — and this part is almost too brazen to believe. Cloudera allegedly created an email account that did not accept external emails. Then, they instructed American job applicants to send their applications to that very same broken, dead-end address. One U.S. worker actually tried. They sent in their application. They received an automated bounce-back notification. Their shot at a high-paying tech career — gone. Blocked. By design.

That worker filed a charge of employment discrimination with the Civil Rights Division. And today, the DOJ responded — with a lawsuit.

How the PERM System Was Weaponized Against You

If you've never heard of the PERM program, this is exactly why it matters to you right now. The Permanent Labor Certification program — PERM — is a federal process that allows employers to sponsor workers for permanent U.S. residency, what most people call a green card. Sounds fine on the surface, right? The catch is this: legally, employers are required to conduct good-faith recruitment of American workers FIRST before they can bring in someone from abroad to fill that role.

The law is clear: during that PERM recruitment process, a company cannot illegally discriminate against U.S. job applicants based on their citizenship status. That protection exists for a reason. It exists because the system was built on a promise — that American workers get a fair shot at American jobs.

The complaint alleges Cloudera made a mockery of that promise. When sponsoring its current employees — workers already on temporary visas — for permanent residency through PERM, the company allegedly failed to recruit U.S. workers in any meaningful, good-faith way. The process was theater. The outcome was predetermined. And American workers were locked out of jobs their own country's laws were supposed to protect for them.

The DOJ's Protecting U.S. Workers Initiative Is Back — And It Has Teeth

This lawsuit isn't a one-off. It's part of a pattern — and a response to that pattern. In 2025, the Justice Department relaunched the Protecting U.S. Workers Initiative, a targeted enforcement effort specifically aimed at companies that illegally discriminate against American workers in favor of those holding temporary employment visas.

Since the Initiative's relaunch, the Division has already secured ten separate settlements in the past year alone. Ten companies. Ten cases where American workers were being pushed aside, passed over, or actively excluded. And now Cloudera becomes the latest name on that list — except this time, it didn't settle. The DOJ is taking it to the Office of the Chief Administrative Hearing Officer, the tribunal with jurisdiction over Immigration and Nationality Act violations.

Assistant Attorney General Harmeet K. Dhillon said it plainly: "The Division will not hesitate to sue companies who intentionally deter U.S. workers from applying to American jobs." And based on today's filing, that is not an idle threat.

What This Means for American Workers — And What You Can Do Right Now

Here's what this case reveals about a reality that millions of American workers in the technology sector already know but rarely see acknowledged in a federal courtroom: the hiring game is being rigged, and it's being rigged by exploiting legal frameworks that were never designed for this purpose.

The PERM process was supposed to be a last resort — a mechanism for employers to fill genuine gaps that American workers couldn't fill. Instead, the allegation here is that it became a backdoor. A tool to circumvent hiring Americans altogether while maintaining the legal veneer of compliance.

I've been covering these stories for a long time. What strikes me about the Cloudera case isn't just the brazenness of allegedly setting up a broken email to deflect American applicants — it's that it apparently worked, at least for a while. These were high-paying, career-defining technology jobs. And American workers were quite literally bounced back.

The DOJ's renewed focus through the Protecting U.S. Workers Initiative signals that the federal government is, at least right now, serious about enforcement. Ten settlements in a year is not nothing. A lawsuit instead of a settlement sends a message that some cases are too egregious to let slide.
