The American Inns of Court, a prestigious but secretive club for judges, attorneys, and law students, has long existed in the shadows of the legal profession, providing its members with social and professional perks that often go unseen by the public eye. While its stated mission is to promote ethics, professionalism, and legal advocacy, recent reports have cast a cloud of suspicion over its operations, particularly concerning the lack of transparency in judicial and attorney membership.

The Elite Network and Its Growing Influence

The American Inns of Court, established in 1987 at Santa Clara University’s law school, operates more like a legal fraternity than a traditional professional association. Its membership includes a select group of judges—some public, others private—along with prominent attorneys and a select group of law students. Yet, this is no open-door network; only a small and carefully curated group of legal professionals gain membership, often after facing what some describe as a “blacklisting” process.

Across the country, there are over 300 chapters of the Inns, but what happens behind closed doors is increasingly drawing scrutiny. These meetings are held away from public view, with media and non-member attorneys barred from entry. Despite the club’s stated purpose to foster civility and ethics, some members of the legal community are questioning whether it’s true purpose is to serve as a vehicle for political influence, judicial lobbying, and a platform for private, off-the-record interactions between judges and attorneys.

According to sources familiar with the club, the monthly gatherings feature more than just formal programs and discussions on legal matters. They often include socializing over lavish meals and engaging in informal skits.

This blend of professional camaraderie and social performances raises eyebrows. Critics argue that it underscores the potential conflicts of interest judges and attorneys face when their professional roles overlap with social activities that may have an effect on their impartiality.

Ethical Concerns: The Law’s Demands on Disclosure

Under California law, judges are required to disclose any professional or personal relationships with attorneys involved in the cases they preside over. This includes membership in organizations like the American Inns of Court. Failure to disclose these associations could be a violation of judicial ethics, jeopardizing a case's fairness and transparency. Unfortunately, members of the Santa Clara chapter and other branches of the Inns are reportedly not adhering to these rules, a matter that could have serious implications for due process.

Justice Patricia Bamattre Manoukian, one of the prominent judges associated with the group, was among those who attended the exclusive 2024 dinner at the Adobe Lodge on the Santa Clara University campus. Videos of such events, typically prohibited by the group, have recently surfaced on social media, showing the gatherings in full swing. With over a million views on TikTok, YouTube, and Twitter, these videos are forcing the public to reckon with the hidden influence wielded by this elite circle of legal professionals.

In some cases, judges have failed to disclose their membership, despite the clear legal obligation to recuse themselves from cases where conflicts of interest might exist. The California Code of Judicial Ethics and Rules of Court mandate this transparency to prevent the appearance of bias in cases where a judge may have a vested interest in the outcome. When judges don’t follow these protocols, it undermines the integrity of the judicial process and damages the public's trust in the legal system.

Membership Paid by Public and Private Funds

What adds to the controversy is the funding structure of the American Inns of Court. Public funds, including government email accounts and taxpayer dollars, have been used to cover the costs of meetings and dinners. Additionally, private law firms and big-ticket attorneys fund and manage the administrative functions of the organization, raising questions about the fairness of this arrangement.

It has been revealed that membership dues cover costs such as meals, social activities, and formal annual dinners, often held at expensive venues. Judges are encouraged to invite attorney guests to these events, which may create opportunities for the expansion of the group’s membership—and, by extension, its influence over the judicial and legal spheres.

Yet, for all its glitz and glamour, the American Inns of Court may be a breeding ground for unethical relationships between judges and the attorneys who appear before them. Social interactions that occur within the confines of the group could impact judicial decision-making and give certain attorneys an edge over others in legal battles—an issue that is more than just theoretical.

Lack of Transparency and the Public’s Concern

The most glaring issue with the Inns of Court is the lack of transparency regarding its membership. With little oversight, the club operates behind a veil of secrecy that shields its members from public scrutiny. This has led to widespread concerns over the undue influence the organization may have on the legal system. What happens at these dinners, where influential judges and lawyers mingle, could have lasting consequences for the cases those judges preside over.

For many, the secretive nature of the organization is a serious issue. If judges are allowed to maintain membership in a club that creates such apparent conflicts of interest, the very foundation of the legal system could be at risk. Litigants, especially those representing themselves in court, may feel the judicial system is rigged against them if they are aware of the exclusive relationships between judges and attorneys in these private social settings.

The Need for Reform and Accountability

With increasing scrutiny on the American Inns of Court and its secretive practices, calls for reform have become more vocal. Transparency and accountability in judicial and legal matters are essential to maintain the public’s trust in the legal system. Judges must disclose their memberships in such organizations to avoid any potential biases or conflicts of interest.

The issue of conflict-of-interest disclosures is not a minor matter. When a judge fails to disclose such affiliations, it violates both the spirit and the letter of the law. As this controversy continues to unfold, the American Inns of Court may find itself under greater scrutiny, as the public demands greater transparency and accountability from those who hold the power to shape the law.

The American Inns of Court, once a quiet social gathering for legal professionals, now finds itself at the center of a storm of ethical questions and public concern. As more details emerge about the nature of its membership, funding, and private events, the need for transparency and reform becomes clear. The legal system must be held to the highest standards of integrity, and organizations like the Inns of Court must operate with the utmost transparency to avoid compromising the public’s trust.
