Empower Oversight

Empower Oversight, a nonprofit whistleblower agency, made a statement on Tuesday. President Tristan Leavitt announced that FBI agent Marcus Allen, had been retaliated against for protected disclosures to Congress, had settled with the agency. 

Marcus Allen, an FBI staff operations specialist, found himself at odds with the FBI's handling of the Capitol violence.

 According to disclosures made to Congress, Allen raised concerns about the bureau's response and FBI Director Christopher Wray's testimony regarding the involvement of confidential human sources on January 6th. 

His security clearance was pulled when he wrote to his leadership chain that “There is a good possibility the DC elements of our organization are not being forthright about the events of the day or the influence of government assets.”

This prompted a prolonged legal battle.

Allen resigned from the FBI and was awarded full back pay and benefits for the 27 months he was “unjustly suspended,” Leavitt explained.

The nonprofit also withdrew its retaliation complaints filed on Allen's behalf.

“Mr. Allen and his family had to survive on early withdrawals from their retirement accounts in order to continue administratively challenging the FBI’s improper revocation of his security clearance,” Leavitt wrote to Horowitz.

“For 13 of those months Mr. Allen also waited on your office to complete and report on its investigation into the FBI’s abuse of the security clearance process to retaliate against him,” he added.

“While waiting for your office to complete its work and for the FBI to consider our appeal of his clearance revocation, the Bureau denied Mr. Allen’s request to accept other employment and even argued that his family could not accept charitable donations from the public because he was technically still subject to gift rules—although he had no pay and no official duties for more than two years.”

FBI Whistleblower

The ordeal began when Allen, a staff operations specialist, found himself at odds with the FBI's handling of the Capitol violence. 

According to disclosures made to Congress, Allen raised concerns about the bureau's response and FBI Director Christopher Wray's testimony regarding the involvement of confidential human sources on January 6th. 

“There is a good possibility the DC elements of our organization are not being forthright about the events of the day or the influence of government assets,” Allen later wrote in a letter to his leadership chain, which led to his security clearance being pulled.

Former FBI field office director Steven D’Antuono testified to the Judiciary panel last year that the bureau did not know how many paid informants were present on Jan. 6, 2021. He said they would conduct an audit to get the number.

Allen claimed that the agency knew more than they disclosed.

The FBI still has not released the number of undercover agents present at the riots. And they haven't disclosed, if any of the agents were encouraging the Capitol Hill rioters.

IG Report

The Inspector General's report, released on May 14, disclosed significant retaliation against whistleblowers within the FBI. It confirmed that at least 106 agents faced retaliation for an average of nearly 18 months each.

In response to Allen's reinstatement, Judiciary Chairman Jim Jordan hailed it as a victory for whistleblowers and urged further action to support those who come forward with information about government misconduct during the January 6 Capitol Hill riots.

 Jordan called on the FBI to reinstate the security clearances of other whistleblowers, including Garret O’Boyle and Stephen Friend, who testified alongside Allen before the House Judiciary Committee.

Despite Allen's vindication, concerns persist about the chilling effect of retaliation on future whistleblowing efforts within the FBI. 

Empower Oversight President, Tristan Leavitt, called on Inspector General Michael Horowitz to disclose the full findings of his retaliation probe, emphasizing the importance of accountability and transparency in addressing abuses within the bureau.

Whistleblowers play a vital role in promoting accountability and integrity within government agencies. The reinstatement of Allen’s security clearance marks a step forward in the ongoing struggle to protect those who speak truth to power.
