FCC AT&T Deal Approval Triggers Uproar From Rural Carriers Over Competitive Fallout

FCC AT&T Deal Approval

Wireless carriers serving rural America erupted in frustration this week after federal regulators quietly signed off on AT&T’s $1 billion spectrum license purchase from UScellular, a move critics likened to tightening the corporate grip on the nation’s airwaves.

The FCC’s Wireless Telecommunications Bureau authorized the transfer Wednesday, approving AT&T’s acquisition of lower 700 MHz and 3.45 GHz spectrum licenses and simultaneously granting a waiver allowing AT&T to exceed the usual 40 MHz holding cap in the 3.45 GHz band. But the stamp of approval — issued at the staff level rather than by the full Federal Communications Commission — ignited backlash across the rural telecom landscape.

Rural Wireless Association Says FCC Handed Big Carriers the Keys

The Rural Wireless Association, long wary of consolidation in the telecom sector, denounced the decision as yet another domino in a series of approvals that have effectively carved up UScellular’s once-robust spectrum portfolio.

To the RWA, the picture is unmistakable: AT&T, T-Mobile and Verizon are snapping up spectrum in rapid succession, leaving community providers scrambling to survive.

“These two staff-level decisions along with an expected decision allowing Verizon to acquire UScellular spectrum collectively amount to the death of mobile wireless competition,” said Carri Bennet, the association’s outside general counsel.

Bennet warned that consumers — especially in underserved areas — will pay the price. With fewer competitors and deeper market concentration, she said the dominant trio will fall into “conscious parallelism,” raising prices and mirroring each other’s plans until innovation withers and choice disappears.

The RWA also questioned why the FCC delegated the approval to bureau staff rather than holding a vote among commissioners, suggesting the streamlined process sidestepped broader scrutiny.

FCC Defends Decision, Says Competitive Harm Is Unlikely

The FCC’s order, released Wednesday, lays out the bureau’s rationale in meticulous detail. Its analysts determined the transfer does not exceed the agency’s overall spectrum screen, which evaluates whether an entity controls too much of the airwaves.

“After carefully evaluating the potential competitive effects of the proposed assignments, we find that the likelihood of competitive harm is low,” the agency wrote.

The commission said the move will bolster AT&T’s network coverage, increase its capacity, and deliver improved performance — benefits the FCC framed as clearly aligned with the public interest.

As for the controversial 3.45 GHz aggregation waiver, the FCC argued that the circumstances warranted flexibility. Allowing AT&T to hold more spectrum in that band, the bureau said, would “ensure the spectrum at issue is put to rapid use,” accelerating service upgrades and deployment.

The agency did not immediately respond to requests for comment on Thursday.
