LOS ANGELES, CA - When cameras rolled on “It Ends With Us,” few could have predicted that the off-screen story would eclipse the film itself. Now, the legal battle among Justin Baldoni, Blake Lively, and their insurer is set to redefine the rules for Hollywood’s risk and reputation management.

A federal lawsuit filed this week by Harco National Insurance doesn’t just threaten Baldoni’s bottom line—it’s poised to send shockwaves through both the entertainment and insurance industries. The core question: Who pays when a studio and its star go to war over allegations of on-set misconduct?

Justin Baldoni, the director and producer behind “It Ends With Us,” and his company Wayfarer Studios, now find themselves the target of a legal salvo launched by their own insurer. The latest twist: Harco National Insurance, which provided the production’s crucial directors-and-officers and employment practices coverage, is asking a New York federal court to declare it has no duty to pay Baldoni’s or Wayfarer’s mounting legal fees.

How Did We Get Here?

  • Blake Lively, who stars in the adaptation and is backed by her husband Ryan Reynolds, initiated legal action against Baldoni in December 2024, alleging sexual harassment on set and claiming she faced retaliation after raising her concerns.
  • Justin Baldoni and Wayfarer, backed by billionaire co-founder Steve Sarowitz, countered with a $400 million lawsuit, accusing Lively and Reynolds of orchestrating a campaign to destroy Baldoni’s reputation.
  • The litigation quickly ballooned: Baldoni subpoenaed Taylor Swift, alleging she was targeted in an extortion plot by Lively, and brought a related claim against Wayfarer’s former publicist for breach of contract.

In a detailed 21-page complaint, Harco National Insurance claims it is not obligated to cover Baldoni’s or Wayfarer’s legal defense for several reasons:

  1. The alleged sexual harassment took place from April to June 2023—months before Harco’s policy began.
  2. Wayfarer failed to inform Harco about Lively’s complaints, despite being asked about potential claims during renewal.
  3. The policy excludes incidents or claims known before coverage started.

Harco’s lawyer, Evan Shapiro, wrote:

“Despite this notice, and despite the November 2023 Demand and additional allegations of sexual harassment presented by Lively during a January 2024 meeting, Wayfarer’s 2024 Renewal Application advised Harco that there was no claim, notice of potential claim, or any situation that may give rise to a claim within the last 12 months.”

Harco alleges Wayfarer’s omissions mean it has no duty to defend or indemnify against Lively’s claims, nor those arising from related litigation.

Coverage at Stake

  • $2 millionfor directors and officers
  • $2 millionfor employment practices and third-party liability

If Harco prevails, Baldoni and Wayfarer face not only the costs of litigation with Lively but also the risk of losing millions in policy-backed indemnity.

Blake Lively’s decision to take her claims public triggered a cascade of legal actions:

  • Lively’s lawyers, in November 2023, emailed Wayfarer to formally raise harassment complaints, a move Harco says should have been disclosed immediately.
  • Lively alleges Baldoni and his team retaliated, damaging her reputation and professional relationships.
  • Baldoni and Wayfarer countered that Lively and Ryan Reynolds orchestrated a campaign to defame Baldoni for speaking up.

Why the Insurer’s Lawsuit Matters Now

Harco’s action—seeking a declaratory judgment—could force Wayfarer to cover a six- or seven-figure legal bill without help. In June, Harco wrote a denial letter, citing “circumstances that may wholly or partially limit coverage,” and pointing out Wayfarer’s renewal paperwork failed to disclose the “known situation” with Lively.

If the insurer’s stance is upheld, other studios and filmmakers may face much stricter scrutiny and less generous policy terms moving forward.

If Harco’s lawsuit succeeds, expect to see new best practices—and much tougher insurance applications—across Hollywood and beyond.
