WASHINGTON, DC - On September 25, 2025, a federal grand jury in the Eastern District of Virginia indicted former FBI Director James B. Comey Jr. on two counts: false statements and obstruction. The indictment, returned after years of scrutiny surrounding Comey’s conduct during and after his FBI tenure, strikes at the heart of one of the most politically divisive eras in modern American law enforcement.

At issue is whether Comey misled Congress during sworn testimony before the Senate Judiciary Committee on September 30, 2020. According to the indictment, Comey “willfully and knowingly” made materially false statements when asked about his authorization of anonymous sources tied to an FBI investigation.

Specifically, prosecutors allege Comey denied ever authorizing FBI personnel to act as anonymous sources for news outlets, when in fact he had empowered Daniel Richman—his confidant, attorney, and later revealed to be an unpaid FBI affiliate—to leak information tied to “Person 1.”

Hillary Clinton Identified as “Person 1”

The veil of ambiguity was lifted when ABC News confirmed that “Person 1” is Hillary Clinton. Reporter Mike Levine cited sources confirming that Richman, designated “Person 3” in the indictment, funneled FBI information to journalists regarding Clinton-related investigations.

This revelation ties the indictment not only to Comey’s credibility, but also to the lingering questions about the FBI’s handling of matters connected to Hillary Clinton’s tenure as Secretary of State.

Daniel Richman: The “Media Mole” at the Center

Richman’s role has long been controversial. In newly declassified DOJ memos, investigators documented that Comey instructed Richman to leak classified information to New York Times reporter Michael Schmidt in May 2017. That leak, by design, fueled calls for the appointment of Special Counsel Robert Mueller.

Critically, Comey never disclosed during his congressional testimony that Richman was one of his personal attorneys, nor that he had functioned as an FBI insider. That omission goes directly to the heart of the indictment: prosecutors say Comey misled Congress by concealing Richman’s true status and by denying that he authorized leaks on “Person 1.”

The Subpoenas for Hillary and Bill Clinton

In a parallel development, both Hillary and Bill Clinton have been subpoenaed to testify before Congress as part of the House Oversight Committee’s expanding probe into FBI conduct, political interference, and potential cover-ups.

Congressional subpoenas of former First Families are rare and politically explosive. Lawmakers are seeking sworn testimony from the Clintons to establish whether they were aware of or involved in the dissemination of FBI-related information that ultimately landed in the media.

While Hillary Clinton remains active on the speaking circuit, reports suggest Bill Clinton’s health has significantly declined. Insiders indicate this may serve as a potential legal and procedural avenue to delay or avoid live testimony, either through requests for accommodations or motions to quash subpoenas.
