Website Argument Falls Flat

Judge Boulware underscored that Bilzerian’s strongest tie to Nevada—that Ignite’s website could be accessed by residents—was insufficient. He cited the Ninth Circuit’s 2002 ruling in Rio Properties Inc. v. Rio Int’l Interlink, which held that mere website accessibility does not establish personal jurisdiction.

“The complaint makes no mention of the level of interactivity or commercial nature of the website,” the judge noted, before granting the defendants’ motion to dismiss.
