However, the U.S. Court of Appeals for the Tenth Circuit in Denver reversed that decision when it came before them on appeal. The appellate court ruled that while the company shouldn’t have won, there wasn’t enough evidence to rule in favor of the plaintiffs. The appellate court returned the case to district court. The Court’s opinion said that Kellogg’s “neutral employment policy” may not actually be considered reasonable accommodations since the lawsuit is dealing with plaintiffs who are practicing their religion.
