A federal lawsuit accuses Guardian Law and marketing firm ClicTree LLC of violating federal telemarketing laws by making unsolicited robocalls to consumers on the National Do Not Call Registry, igniting a legal battle that could have wide-reaching implications.

Wesley Newman, an Illinois resident, filed a proposed class action Thursday, claiming he received 41 unwanted calls—many using prerecorded messages—as part of an alleged lead-generation scheme for the law firm Kaila & Solomon Law Group LLC, doing business as Guardian Law.

Robotic Voices and Relentless Calls

Newman described the calls as automated and impersonal, with an "obvious robot" prompting him about past car accidents and potential compensation. In one instance, he stayed on the line and was connected to a live agent named “Steve”, who probed for details about an accident before offering legal help.

After a series of conversations, Newman said he was ultimately routed to Legal Help Advisors, a client intake company allegedly working for Atlanta-based Guardian Law, where he was sent a retainer agreement via email.

When Newman objected, stating the calls were illegal and demanded removal from the call list, he received another follow-up call within 20 minutes from someone named Alex, further pushing the legal services.

Despite repeated do-not-call requests, Newman claims the calls persisted and continue to this day.

Alleged Telemarketing Violations

Newman contends that ClicTree, which placed the calls, and Guardian Law, which benefited from the leads, violated the Telephone Consumer Protection Act (TCPA) by:

• Calling numbers on the National Do Not Call Registry
• Using automated dialing systems and prerecorded messages
• Continuing calls after explicit requests to stop

While ClicTree directly placed the calls, Newman alleges Guardian Law is equally responsible for knowingly accepting the leads and authorizing continued outreach, despite the legal risks.

“Guardian is liable for telemarketing calls placed by ClicTree and any subvendors they may have hired,” Newman stated, adding that FCC regulations prohibit companies from dodging liability by outsourcing telemarketing.

Class Action Seeks Millions in Damages

Newman’s lawsuit seeks class-action status for:

• U.S. residents who received prerecorded telemarketing calls from ClicTree in the last four years
• A subclass of individuals who received Guardian Law-related telemarketing calls
• Individuals who were called multiple times despite being on the Do Not Call Registry for at least 31 days
• Consumers who requested removal but continued to receive calls

Under the TCPA, Newman and class members could be awarded $500 per violation, with potential triple damages if the actions are deemed willful or knowing, pushing total liability into the millions.

Lawsuit Seeks to End Illegal Robocalls

Beyond financial damages, Newman seeks a court order prohibiting ClicTree and Guardian Law from:

• Calling numbers on the National Do Not Call Registry
• Contacting individuals who have opted out
• Using robocall tactics for lead generation

Neither Guardian Law nor ClicTree has publicly responded to the allegations.
