Trump and Co-Defendants Seek to Appeal Judge’s Decision in Georgia Election Cases

In a Wednesday certificate of immediate review, Georgia Judge Scott McAfee ruled to grant Trump and his co-defendants’ the right to appeal his latest ruling in the Georgia election cases. 

They are asking for a review of his decision to keep Willis on the racketeering case.

The judge claims that he welcomes the review which is of “such importance to the case that immediate review should be had.”

Georgia Election Cases Background

Judge McAfee is allowing Donald Trump and his election interference co-defendants to appeal his order denying the disqualification of Fulton County District Attorney Fani Willis.

This appeal follows McAfee's ruling last week against dismissing the case and disqualifying Willis.

Former President Donald Trump and several co-defendants filed their motion requesting permission to appeal the Judge’s decision on Monday.

The charges against Trump and his co-defendants stem from allegations by Willis that they engaged in illegal activities to influence state officials in an attempt to overturn the results of the 2020 presidential election in Georgia.

 Among the charges are violations of the Georgia RICO Act, criminal solicitation, criminal conspiracy, filing false documents, and making false statements. Trump has pleaded not guilty to all charges, and a trial date has yet to be set.

McAfee Says Wade Must Go 

Judge McAfee ordered Fulton County special prosecutor Nathan Wade to resign from the case. McAfee warned that if Wade did not withdraw, Willis would be disqualified from prosecuting Trump. 

Wade complied with the order promptly and resigned.

Judge McAfee also dismissed six counts in the case related to solicitation of violation of oath by public officers.

 In his order, McAfee highlighted a lack of sufficient detail in the state's allegations, stating that while the charges contained essential elements of the crimes, they failed to specify the nature of the underlying felony solicited.

Alleged Conflict of Interest 

Four of the co-defendants, including Trump, have alleged that Willis and Wade were romantically involved before Wade was hired in 2021.

They claim that this relationship constituted a conflict of interest, as Wade's hiring by Willis's office could have benefited financially from taxpayer funds.

Allegations of misuse of funds for personal trips have also surfaced, with claims that Wade billed taxpayers for vacations taken with Willis.

Both Willis and Wade denied any pre-existing romantic relationship and claim they shared the costs of their trips evenly.

 Nevertheless, cell phone evidence presented in court contradicts their testimonies, suggesting that they were spending nights together years before Willis hired Wade. And they may have perjured themselves at the hearing.

As the legal battle continues, the case remains a focal point in the ongoing scrutiny of the 2020 election and its aftermath. The outcome of the appeal could have far-reaching implications for all parties involved.
