NuVasive Inc., along with their counsel at Bradley Arant Boult Cummings LLP, are staring down the barrel of a sanctions request in a lawsuit that accuses them of employment discrimination.

The reason? A behind-the-scenes text message to a witness during a deposition.

Bradley Arant Suit: Shocking Turn of Events

At a recent deposition, Wendy Harrison, a representative for NuVasive, faced the counsel for George Darrow, a former employee who claimed he was let go because of a disability stemming from thyroid cancer.

It is believed Darrow's health issues arose from radiation exposure during his tenure with the company. Harrison initially testified that no email evidence existed regarding certain statements about Darrow's work capabilities.

Yet, in a twist worthy of a courtroom drama, she backtracked mere moments later, revealing such documentation did, in fact, exist.

This zig-zag testimony led to a revelation that would send shockwaves through the courtroom.

Alysa Ward, an attorney for NuVasive from the Bradley Arant firm, had sent a text to Harrison during the deposition, advising her to amend her testimony.

The Ripple Effect

Upon this revelation, Darrow's lawyers, Benjamin E. Olive and Matthew C. Sanchez, immediately sought to dig deeper.

They requested the court to green-light a fresh round of discovery, focusing on electronic communications and additional in-person depositions.

Their mission? To unearth any further instances of communication during depositions.

Their diligence bore fruit. A second deposition, this one of NuVasive's Dustin Shields, showcased another set of covert text exchanges.

This time between Shields, Alysa Ward, and Shelly Ward, a senior case manager at NuVasive. Interestingly, the evidence hints that both sets of text messages originated from Alysa Ward's phone.

The plaintiff's motion highlighted the murky waters they were navigating, stating, "In the present case, the full extent of the deposition misconduct is not yet fully determinable." This saga has added a layer of complexity to a case that began in October 2022 when Darrow alleged discrimination under the Americans with Disabilities Act.

What's Next?

As the legal tempest rages on, Darrow alleges the company gave him the cold shoulder when he sought a role that would protect him from further radiation exposure, as recommended by his doctors. This lawsuit, which traces its origin to Darrow's dismissal in December 2020, is set to culminate in a courtroom showdown this coming February.
