Sometimes the most expensive mistake isn't what a lawyer says in court — it's what they never bother to mention at all. That's the explosive claim at the heart of a new lawsuit against Ryan Ryan Deluca LLP, where an obstetrician-gynecologist says her own attorneys' silence about a settlement offer turned a manageable case into a $50 million nightmare.

The Allegation That Started It All

In a complaint filed Wednesday in Connecticut federal court, Dr. Sara B. Elias accused the firm and two of its attorneys of failing to tell her about what she calls a "reasonable" settlement offer — a failure that, she alleges, ultimately exposed both her and her employer to a staggering $50 million judgment favoring a patient injured during childbirth. The Ryan Ryan $60M Malpractice Lawsuit paints a picture of a legal team that, according to Elias, prioritized its own interests over hers at nearly every turn.

A Deposition Gone Disastrously Wrong

Beyond the alleged missed settlement, Elias also claims RRD botched preparation for a critical deposition — one she describes as nothing short of a "disastrous" turning point in the case. According to the complaint, Elias's own expert witness, Dr. Marshall W. Carpenter, testified that "surgical errors" caused the injuries sustained by patient Elizabeth Tigani during an emergency cesarean section Elias performed at Yale New Haven Health's Greenwich Hospital.

When Your Own Witness Undermines Your Case

Carpenter's testimony, the complaint argues, "constituted a de facto concession of liability and causation and, thereby, rendered the case indefensible" — essentially a witness meant to defend Elias instead handing ammunition to the other side. This was especially jarring given that, in an earlier expert disclosure, Carpenter had promised to "refute every allegation of negligence" and affirm that Elias "complied with the standard of care" during the procedure — a complete reversal that blindsided the defense.

The Settlement Offer That Allegedly Vanished

Before that fateful deposition, Tigani — represented by David Golub of Silver Golub & Teitell LLP — reportedly offered to settle her claims against Elias specifically for $500,000, according to the complaint. But Elias claims she never heard a word about that number from her own lawyers at RRD. Had she known, Elias insists, "she would have jumped at the opportunity and demanded that the case be settled for that amount" — a claim that, if true, describes a missed off-ramp that could have avoided the entire disaster.

The Price Tag Kept Climbing

After the damaging deposition, Tigani's combined settlement offer covering both Elias and her employer, Westchester Medical Group PC, jumped to $4 million, the complaint states. Elias alleges she repeatedly begged RRD to settle within the $2 million limits of her insurance policy — pleas she says were ignored entirely.

Names Behind the Firm

Also named as defendants in the suit are RRD partner John F. Costa and attorney Ryan J. Cesario, who was with the firm at the time but now appears to practice elsewhere, according to Connecticut Judicial Branch licensing records.

The Firm Pushes Back

RRD managing partner Robert O. Hickey didn't hold back in response. "The complaint is without merit and contains numerous inaccurate and false allegations," he told Law360 on Friday. He added, "While we are disappointed that Dr. Elias chose this path, we are confident that we will prevail in this case" — a direct rebuttal to allegations he clearly considers baseless.

Elias tells a starkly different story, however, alleging RRD's lawyers were "motivated by elevating and promoting their business interests and purposefully disregarding, neglecting, ignoring and spurning her best interests."

The Birth That Led to Tragedy

The underlying medical story is its own harrowing tale. According to Elias, patient Tigani initially refused a C-section after difficulty giving birth, attempting to deliver naturally for several hours before finally agreeing to the procedure. During the operation, Tigani's uterus reportedly tore from her vagina, and she also suffered a significant laceration to her bladder — devastating injuries that would soon become the center of a bitter legal dispute over their cause.

Competing Theories on What Went Wrong

The cause of those injuries became fiercely contested. Elias maintains the baby's head had become lodged against Tigani's pelvis, requiring her to lift it during the procedure — and she believes the resulting injuries stemmed from "shearing forces" that occurred naturally during labor, not from any surgical misstep. Carpenter, however, reportedly suggested Elias had incorrectly placed her hand outside the uterus while attempting to free the baby's head — an opinion Elias flatly disputes.

A Verdict That Changed Everything

A jury ultimately awarded Tigani more than $30 million. Elias says the news of that outcome reached her not through a phone call or a meeting, but via text message — and that RRD's attorneys "never spoke to her about the bad outcome of the case" afterward, a detail that underscores just how disconnected she felt from her own legal team.

The Bill Kept Growing

An additional $20 million in interest was later tacked onto the verdict, according to Elias, ballooning the total financial exposure even further.

A Contrast in Outcomes

Notably, Greenwich Hospital — represented by Wiggin and Dana LLP — chose a different path entirely, "wisely" settling its portion of the case, Elias points out. She argues RRD should have recognized the same warning signs and understood the career, financial and emotional fallout a massive verdict could unleash. "The news media stories and widespread negative publicity about the massive verdict would never have occurred if the Tigani case had been timely and properly settled," the complaint states.

What Elias Is Seeking

The lawsuit alleges legal malpractice, intentional and negligent infliction of emotional distress, and a violation of the Connecticut Unfair Trade Practices Act, with Elias seeking $15 million in damages on each count — adding up to the $60 million total at the center of the case.

Costa and Cesario did not respond to Law360 inquiries Friday. An attorney for Elias also did not reply to a message seeking comment.

The Legal Representation

Elias is represented by Joseph Lanni of The Jacob D. Fuchsberg Law Firm LLP. Counsel information for the defendants was not immediately available.

For a doctor who once stood at the center of an operating room, this lawsuit now places her at the center of a very different kind of battle — one where the stakes are no longer measured in surgical outcomes, but in dollars, silence and broken trust.
