Disney Says Trump FCC Is Using ABC Licenses to Pressure and Punish Speech

What’s Really at Stake in the ABC-FCC Fight

  • Disney says the FCC’s extraordinary early review of eight ABC station licenses is already changing what the network puts on television.
  • The government says the FCC is investigating legitimate regulatory issues and argues Disney brought its constitutional challenge in the wrong court.
  • The case could determine how far a presidential administration may push a broadcaster through licensing power without crossing the First Amendment line.

Disney’s fight with the Federal Communications Commission has moved beyond angry presidential posts and political complaints about television coverage. It is now a federal constitutional case asking a much harder question: Can the government use legitimate regulatory powers in a way that effectively pressures a broadcaster to change what it says?

Disney says that is exactly what is happening.

During a two-hour hearing Tuesday, attorney Beth Wilkinson asked U.S. District Judge Loren AliKhan to stop the FCC’s early review of licenses belonging to eight ABC-owned television stations. Wilkinson said ABC’s editorial judgment is already being affected by the possibility that decisions displeasing the Trump administration could influence the regulatory process.

The case is American Broadcasting Companies, Inc. v. Federal Communications Commission, No. 1:26-cv-02902, pending in the U.S. District Court for the District of Columbia. Disney and ABC sued in August, alleging First Amendment retaliation and seeking declaratory and injunctive relief. CourtListener

The numbers make the dispute unusual. The FCC ordered ABC in April to seek renewal of eight station licenses even though the licenses normally would not expire until between 2028 and 2031. KABC Los Angeles, KGO San Francisco, KFSN Fresno, WABC New York and other major-market stations were pulled into the process years early. Disney’s complaint says the FCC had not used an early-renewal procedure like this in more than half a century. CourtListener

The FCC does have authority to call licenses up early. Its May public notice cited 47 C.F.R. §73.3539, which permits an early renewal when the agency considers it essential to an investigation. The FCC says its actions grew from investigations into Disney and ABC employment practices and what it considered inadequate responses to information requests. FCC Docs

That is where this case gets legally interesting.

Disney does not need to prove the FCC lacks regulatory authority. The stronger issue is whether otherwise lawful authority was allegedly used for an unlawful purpose — retaliation against protected speech. Disney’s complaint specifically invokes the Supreme Court’s 2024 decision in NRA v. Vullo, which reaffirmed that government officials cannot wield state power to punish disfavored expression. CourtListener

Judge AliKhan zeroed in on that distinction. If this was essentially a dispute over producing documents, she asked government counsel why ABC warranted such an extraordinary licensing measure when regulators presumably encounter discovery disputes with other licensees.

The government has a substantial procedural defense. Justice Department attorney Dimitar Georgiev-Remmel argues the district court lacks jurisdiction because Congress directed review of FCC licensing orders to federal courts of appeals. The government also argues ABC cannot show irreparable injury because the stations still possess their licenses and any adverse FCC action can ultimately receive judicial review. CourtListener

ABC counters that the injury is happening now — before any license is actually lost.

Wilkinson told the court, “Our editorial decisions are being affected right now.” ABC says The View has avoided inviting political candidates amid FCC scrutiny, while Jimmy Kimmel’s interview with Democratic Senate candidate James Talarico was placed online rather than broadcast after concerns involving federal equal-opportunity rules.

That may ultimately be the most important evidence in the case. Constitutional coercion does not always require the government to pull the trigger. Sometimes the legal question is whether placing a regulator’s finger on it causes the speaker to change course.

AliKhan did not rule Tuesday. The government was directed to submit additional argument by October 9 and ABC by October 14, meaning a decision on Disney’s preliminary-injunction request is not expected before mid-October.
