The renewed investigation into an alleged 2024 sexual assault at Cornell University is rapidly becoming about something larger than one night at a fraternity house.

It is becoming a case study in how sexual-assault allegations should be investigated.

A former Cornell student identified as Jane Doe alleges in a recently filed civil lawsuit that she was drugged and sexually assaulted by multiple members of the Chi Phi fraternity in October 2024. Several of the accused men have denied participating in nonconsensual sexual activity or denied touching her at all. No criminal charges have been filed.

The case was initially not prosecuted. Tompkins County District Attorney Matthew Van Houten has said the woman's November 2024 sworn statement did not allege that she had been drugged against her will or gang raped and instead described voluntary participation in drug use and sexual conduct.

Cornell alum Sami Sage, co-founder of Betches Media, launched a Change.org petition on September 27, 2026, one day before District Attorney Matthew Van Houten publicly announced the reopening. The petition, titled CORNELL ALUMNI SUPPORTING JANE DOE, explicitly called for accountability, transparency, an investigation and institutional changes, and threatened to withhold alumni financial support. It subsequently grew to tens of thousands of verified signatures.

Then the situation changed again.

New York Gov. Kathy Hochul removed the investigation from the local district attorney and appointed Attorney General Letitia James as special prosecutor. James says her office will conduct a process guided by "the facts and the law."

And that is exactly where this case becomes particularly interesting.

There is a remarkable real-world lesson about sexual-assault investigations buried inside the Netflix limited series Unbelievable.

The series is based on the true story of an 18-year-old Washington woman known as Marie who reported in 2008 that a masked stranger broke into her apartment, bound her and raped her.

Detectives became suspicious.

There were inconsistencies in her accounts. People close to Marie questioned her behavior. Investigators repeatedly interviewed her, focused increasingly on discrepancies and eventually persuaded her to recant.

Authorities then charged her with making a false report.

There was just one enormous problem.

She had been telling the truth.

Years later, detectives Stacy Galbraith and Edna Hendershot were investigating sexual assaults hundreds of miles away in Colorado. Instead of beginning with a conclusion about their victims' credibility, they began assembling evidence.

They compared separate attacks.

They examined crime scenes.

They tracked similarities in the attacker's methods.

Investigators recovered tiny quantities of touch DNA. They studied surveillance information involving a white Mazda pickup. They examined shoe impressions. Victims had described similar physical characteristics and methods used by their attacker.

Piece by piece, evidence that looked insignificant by itself became powerful when combined with everything else.

Their investigation eventually led to Marc O'Leary.

A search of O'Leary's home produced Adidas shoes consistent with footprints found during the investigation, gloves, a mask, a camera, bindings and women's underwear. Investigators also recovered photographs of victims from his computer.

Then detectives found something extraordinary.

Among the photographs was a young woman they did not recognize, bound and gagged on a bed. Another photograph showed her learner's permit.

It was Marie.

The woman police had accused of fabricating her rape had been photographed by her rapist.

O'Leary ultimately pleaded guilty in the Washington cases, including Marie's, and received lengthy prison sentences. An outside review later concluded that investigators had effectively coerced Marie into saying she lied and had elevated relatively minor inconsistencies while overlooking evidence supporting her original report.

That history matters to Cornell — but not because it tells us whether Jane Doe's allegations are true.

It tells us what a serious investigation must look like before anyone reaches that conclusion.

There are already competing narratives in the Cornell case. The district attorney emphasized Jane Doe's signed statement. But reporting on the fuller police interview transcript indicates she also told Cornell police, "I can say with 100% confidence I was raped." The district attorney has said he did not receive the complete interview transcripts when the original prosecution decision was made.

Meanwhile, Cornell's own disciplinary investigation was far more extensive than the original criminal review may have appeared from the outside. Recently unsealed records indicate the university's process involved dozens of witnesses, months of investigation and a lengthy hearing. Cornell ultimately imposed sanctions that included expulsions and suspensions, although findings and sanctions varied among the accused students.

None of that establishes criminal guilt.

University disciplinary proceedings and criminal prosecutions operate under different rules, standards and consequences. Likewise, an allegation in a civil complaint is an allegation, not a judicial finding.

But the contrast creates the central investigative question now confronting James' office:

What evidence existed, who had it, and who actually examined it?

Investigators can reconstruct an extraordinary amount of a person's movements and communications today. Phones may contain location histories, messages, photographs, videos and app activity. Social-media platforms can contain messages and timestamps. Surveillance cameras, rideshare records, financial transactions, access-control systems and witnesses can establish when people arrived and departed.

And investigators should look for evidence pointing in both directions.

If Jane Doe's account is accurate, independent evidence may corroborate portions of it.

If one or more accused men were elsewhere, never entered the room, had communications inconsistent with the allegation or possess other exculpatory evidence, investigators need to establish that too.

Even the controversial Snapchat messages associated with the Cornell case must be investigated in context — identifying who wrote them, when they were sent, who received them, who responded and whether subsequent actions corroborate or contradict what the messages appear to suggest.

That is perhaps the most important lesson from Unbelievable.

The detectives who got Marie's case wrong were looking increasingly for evidence that Marie was lying.

The detectives who ultimately solved it were looking for evidence showing what actually happened.

Those are not the same investigation.

The Cornell case should not begin with the assumption that Jane Doe is telling the truth. It should not begin with the assumption that the seven accused men are guilty. And it should not begin with the assumption that inconsistencies necessarily establish that an allegation is false.

It should begin with the evidence.

James' investigation now has an opportunity to reconstruct the case from the beginning - interview witnesses independently, examine the original statements rather than summaries of them, analyze electronic evidence, compare accounts against timestamps and other objective records, identify inconsistencies on all sides and determine whether those inconsistencies are material.

The outcome may vindicate the accuser's allegations. It may exonerate one or more of the accused. It could produce a far more complicated answer in which evidence supports some allegations but not others.

That is why investigations exist.

Unbelievable ultimately wasn’t a story about detectives proving that a young woman lied about rape.

It was a story about what happened when detectives thought they had proved she lied — and stopped looking for the man who raped her.

Nearly two decades later, the Cornell investigation presents the justice system with the same fundamental challenge from another direction:

Don't decide what happened first.

Investigate until the evidence tells you.
