Timothy Busfield Child Sex Abuse Indictment Dismissed Due to Prosecutorial Misconduct

Timothy Busfield

ALBUQUERQUE, N.M. — Actor and director Timothy Busfield, known for his roles in “The West Wing,” “Thirtysomething” and “Field of Dreams,” has had his child sexual abuse indictment dismissed by a New Mexico judge who found that prosecutorial misconduct and errors in the grand jury process undermined the proceedings. The Oct. 16 ruling represents a significant legal victory for Busfield, who has repeatedly denied the allegations, but it does not necessarily end the case because prosecutors may seek a new indictment.

State District Judge Joseph Montano granted a defense motion to dismiss the indictment, finding that prosecutors failed to act fairly and impartially when presenting the case to a grand jury. The judge said prosecutors improperly instructed jurors about the procedure for calling witnesses, effectively preventing witnesses requested by the panel from testifying.

The ruling cited violations of state grand jury statutes designed to protect the integrity of the process. The dismissal was based on procedural misconduct, not a jury verdict on the underlying allegations.

Busfield's attorney, Amber Fayerberg, said her client was relieved by the decision. She maintained that witnesses who were present and willing to testify could have provided information supporting his defense.

Witnesses were Available for the Defense of Timothy Busfield

Prosecutors disputed the defense's characterization of the grand jury proceedings. They argued that Busfield's attorneys had not followed the proper procedures for submitting evidence and that Busfield had attempted to direct the panel toward favorable witnesses and exhibits during his testimony. The district attorney's office said it was evaluating its options after the ruling.

During a September hearing on the dismissal motion, the defense presented recordings and testimony concerning grand jurors' requests to hear from additional witnesses. Prosecutors maintained that the defense had improperly attempted to influence the proceedings.

Judge Montano ultimately concluded that the way the grand jury was handled violated the legal safeguards governing its work.

Allegations arose during production of 'The Cleaning Lady'

The case stemmed from allegations involving two twin boys who appeared on the television series “The Cleaning Lady,” which Busfield directed in Albuquerque from 2022 to 2024. The children's parents alleged that Busfield inappropriately touched the boys while they were working on the production.

According to a criminal complaint, one boy told investigators that Busfield touched his private areas over his clothing on two occasions, when he was 7 and 8 years old. His twin brother also told authorities he had been touched, although the complaint did not specify the nature or location of the alleged contact.

Busfield surrendered to authorities in January and was released pending further proceedings. A grand jury subsequently indicted him on four counts of criminal sexual contact with a minor under 13.

Busfield denied the allegations, calling them untrue. His attorneys also questioned the circumstances surrounding the accusations, arguing that the boys' initial statements to police differed from later accounts and alleging that their parents had influenced their statements after the children lost their roles on the series. Those assertions were part of the defense's position, not findings that the allegations had been fabricated.

What the ruling means legally

The dismissal highlights the importance of procedural fairness in criminal prosecutions. Grand juries determine whether sufficient grounds exist to issue an indictment, and prosecutors have responsibilities to follow the law governing the presentation of evidence and witness testimony.

When a court finds that a grand jury process was compromised by serious procedural errors, it may set aside the resulting indictment. Such a decision protects the integrity of the justice system, regardless of the defendant's public profile or the seriousness of the accusations.

However, dismissal of an indictment does not automatically establish factual innocence. It also does not necessarily prevent prosecutors from bringing charges again. Whether a new indictment is permissible depends on the wording and legal effect of the court's order, applicable state law and any other relevant legal restrictions.

In Busfield's case, prosecutors had not announced a final decision on whether to pursue another indictment. The ruling therefore leaves open the possibility of further proceedings.

The case also illustrates the distinction between an accusation, an indictment and a conviction. An indictment formally charges a defendant but does not prove guilt. Busfield has denied wrongdoing, and the dismissed indictment did not result in a trial verdict.

A decades-long career in television and film

Busfield built a career spanning acting, directing and producing. He became widely recognized in the 1980s for playing Elliot Weston in the television drama “Thirtysomething,” a role that helped establish his reputation as a versatile character actor. He later appeared in the baseball drama “Field of Dreams” and played White House reporter Danny Concannon on the political series “The West Wing.”

His television credits also include “Trapper John, M.D.,” “Studio 60 on the Sunset Strip” and “The Cleaning Lady.” In addition to acting, Busfield worked extensively behind the camera, directing episodes of television dramas and comedies. His work earned industry recognition, including a Primetime Emmy Award as part of the directing team for “Thirtysomething.”

His directing and producing career made him a familiar presence in television production, where professional relationships, reputation and access to future projects can be especially important.

Family life and professional fallout

Busfield is married to actor Melissa Gilbert, best known for playing Laura Ingalls on “Little House on the Prairie.” The couple married in 2013. Both have children from previous relationships, and their blended family has been part of their public lives.

During grand jury proceedings, Busfield testified that the allegations had turned his life upside down and affected his entire family. He also said he had been “canceled,” reporting that he lost work and that his talent agency had dropped him after charges were filed.

The allegations and criminal proceedings created a serious professional challenge for an actor and director whose career depends on industry relationships and employers' willingness to hire him. The dismissal may improve his ability to seek future work, but it does not guarantee that studios, networks or production companies will restore previous opportunities.

Impact of Criminal Allegations

The case demonstrates how criminal allegations can affect a person's career before a trial takes place, while also underscoring the importance of allowing legal proceedings to determine the status of charges. The consequences for Busfield, his family and his professional future may depend on whether prosecutors bring the case again and how the entertainment industry responds to subsequent developments.

For now, the indictment has been dismissed, Busfield continues to deny the allegations, and prosecutors are weighing their next steps. The ruling resolves a major procedural dispute but leaves the broader legal and professional consequences uncertain.

Editorial note: The dismissal should not be described as a complete acquittal or proof that the allegations were false. The article distinguishes the allegations from established facts and explains that the ruling concerned the integrity of the grand jury proceedings.
