California Botox Doctor Gets 15 Years After $45 Million Medicare Fraud Scheme Exposed Impossible Billing

What the Medicare Records Revealed

  • A California doctor billed more than $19 million for Botox injections supposedly performed on days her medical clinic was closed.
  • Federal prosecutors proved she billed Medicare for California treatments while traveling in Mexico, Hawaii, Las Vegas, Pennsylvania and New York.
  • Investigators said the cover-up went further—medical records were falsified and beneficiary signatures forged after federal authorities began closing in.

LOS ANGELES, Calif. - A Glendale physician convicted of running a sprawling Medicare fraud scheme has been sentenced to 15 years in federal prison after prosecutors showed that her billing records sometimes placed her in two places at once.

Violetta Mailyan, 45, owned and operated Healthy Way Medical Center, a clinic offering beauty and cosmetic services. According to the Justice Department’s sentencing announcement, Mailyan fraudulently billed Medicare more than $45 million for Botox injections that were medically unnecessary, cosmetic, or never performed.

Medicare does cover Botox in certain circumstances, including medically necessary treatment for documented chronic migraines. That created the opening Mailyan exploited. Prosecutors said she submitted thousands of claims for patients who did not qualify for the treatment as billed or never received the injections at all.

But some of the most damaging evidence did not require a complicated medical analysis.

More than $19 million in injections were supposedly administered on dates when Healthy Way Medical Center was closed. Other claims said Mailyan was treating patients in California while travel records and other evidence placed her elsewhere.

The Cabo episode was particularly difficult to explain away.

According to DOJ, Mailyan billed more than $200,000 for Botox services during a period when she was in Cabo, Mexico. On one day, a photograph from her phone showed her at the beach while Medicare was billed $34,560 for services supposedly performed in Glendale.

That detail points to something larger about modern health-care fraud investigations. Claims databases create timestamps, treatment histories and billing patterns that can be compared against clinic schedules, travel records, patient files and other evidence. A false claim does not exist by itself. It leaves a trail.

And prosecutors said Mailyan made that trail worse once investigators appeared.

Evidence at trial showed she falsified medical records and forged Medicare beneficiaries' signatures in an effort to support treatments investigators believed never occurred. One purported patient presented an especially obvious problem—the man was in federal prison during the period when Mailyan claimed to have treated him.

The money also left a trail.

Prosecutors traced fraud proceeds to two Teslas, including a Cybertruck, five California real-estate properties and unusual luxury purchases, including a $12,000 17th-century crossbow and a $3,000 painting.

After a six-day trial in May, a federal jury convicted Mailyan of nine counts of wire fraud and three counts of obstruction of a criminal investigation involving a health-care offense.

The punishment extends well beyond the 15-year prison term.

The court ordered immediate forfeiture of more than $16.02 million in seized real estate, personal property, securities and bank funds. Mailyan was separately ordered to pay $32,904,049.41 in restitution to Medicare. Those numbers matter because forfeiture and restitution serve different functions—the government can seize property tied to criminal proceeds while also pursuing repayment for losses suffered by the Medicare program.

The sentencing judge described the fraud as “truly breathtaking in scope” and called its brazenness “almost unbelievable.”

Mailyan's case also lands amid an aggressive federal push against health-care fraud. DOJ says its Health Care Fraud Strike Force Program has charged more than 6,200 defendants since 2007 whose alleged schemes collectively billed government health programs and private insurers more than $45 billion.

For providers tempted to treat Medicare billing as little more than paperwork, the Mailyan prosecution shows the opposite.

Every claim creates evidence.

And when the clinic is closed, the patient is somewhere else—or the doctor is sitting on a beach in Cabo—that evidence can become very difficult to explain to a jury.
