[LOS ANGELES, CA] - In a bold statement on national television, ICE Director Tom Homin sent a clear warning to protestors disrupting immigration enforcement efforts, saying, "They may find themselves in handcuffs very soon." This comes amid increasing protests against ICE operations, where activists have been physically blocking deportation efforts and shielding undocumented immigrants.

But the key legal question is this: Do these protests qualify as protected free speech, or are they unlawful acts that impede federal law enforcement?

What the Law Says

Obstruction of Justice and Federal Immigration Law

The U.S. Code is explicit regarding interference with federal enforcement actions.

  • 8 U.S.C. § 1324makes it a crime to "conceal, harbor, or shield" an undocumented immigrant from federal authorities.
  • 18 U.S.C. § 372criminalizes conspiracy to prevent federal officers from performing their duties.
  • 18 U.S.C. § 1512(b)(3)penalizes anyone who "hinders, delays, or prevents the communication" of information regarding a federal crime.

This means that protesters who physically block ICE operations or provide sanctuary to undocumented individuals may not be merely exercising free speech—they could be committing a federal crime.

The First Amendment protects free speech and peaceful protest, but it does not shield individuals who engage in illegal activity. Courts have repeatedly held that speech that incites illegal action or obstructs law enforcement is not protected (Brandenburg v. Ohio, 395 U.S. 444 [1969]).

For example:

  • Physically blocking ICE agents from detaining individuals is illegal.
  • Providing false information to federal officers is obstruction.
  • Encouraging people to violate the law (like advising undocumented immigrants on how to evade ICE) can be considered aiding and abetting (18 U.S.C. § 2).

The Supreme Court has ruled in cases like Arizona v. United States (567 U.S. 387 [2012]) that immigration enforcement is strictly a federal matter. States and localities do not have the power to override federal immigration laws.

Prominent politicians, such as Representative Maxine Waters and Representative Adam Schiff, have voiced support for these protests. But could their advocacy expose them to legal liability?

Under 18 U.S.C. § 372, officials who incite actions that impede federal officers could potentially face conspiracy charges. If it can be proven that their words directly led to illegal acts—such as protesters physically obstructing ICE—it is possible they could be investigated for aiding and abetting.

Additionally, California Governor Gavin Newsom’s pro-sanctuary policies are also in direct opposition to federal law. Federal statutes clearly prohibit state or local governments from restricting communication with DHS about an individual's immigration status (8 U.S.C. § 1373). This means that California’s refusal to cooperate with ICE could be legally challenged under the Supremacy Clause (U.S. CONST. art. VI, cl. 2).

Additionally, federal funding could be at risk. Courts have ruled that the federal government has the right to condition funds on compliance with immigration laws (South Dakota v. Dole, 483 U.S. 203 [1987]). If President Trump decides to target California’s funding for violating federal immigration law, the state could face significant financial repercussions.

The federal government has broad authority under existing laws to arrest individuals who interfere with immigration enforcement, and as Director Homin indicated, these arrests could begin soon.
