CLARITY Act Stalls In Senate As Crypto Ethics Fight Deepens

The Senate failed Tuesday to advance the Digital Asset Market Clarity Act, commonly called the CLARITY Act, after lawmakers remained divided over ethics rules governing federal officials with cryptocurrency interests.

The procedural vote failed 49-50, short of the 60 votes needed to move forward. Every Democrat who voted opposed the motion, along with Republican Sens. Susan Collins, Josh Hawley, Jerry Moran and Thom Tillis.

The vote was not final passage. It determined whether the Senate would proceed with consideration of the legislation.

At the center of the disagreement are proposed “ethics guardrails” intended to prevent government officials from personally profiting from cryptocurrency ventures while influencing federal policy.

The Republican-backed version would prohibit covered federal officials and their spouses from receiving compensation for issuing, sponsoring or promoting digital assets.

It also addresses certain substantial financial interests in cryptocurrency businesses. If a covered official owns at least $15,000 in a company that receives a plurality of its revenue from issuing or sponsoring digital assets, the official generally would have to sell the interest or place it in a qualified blind trust.

Violations could carry substantial civil penalties, including forfeiture of profits and penalties reaching hundreds of thousands of dollars.

Democrats, however, have pushed for broader restrictions.

Democrats have proposed extending the restrictions to dependent children, tightening rules governing large cryptocurrency holdings and requiring mandatory divestment in some circumstances rather than allowing officials to place assets into blind trusts.

Because the debate has centered heavily on President Donald Trump’s family cryptocurrency interests, critics of the Democratic proposal argue that expanding the restrictions to family members amounts to an effort aimed specifically at Trump and his children. Democrats and ethics groups supporting broader restrictions counter that family-member provisions are necessary to prevent federal officials from sidestepping conflict-of-interest rules through relatives.

Republicans argue that a qualified blind trust removes an official’s control over the investment and therefore addresses the conflict. Democrats argued that officials with especially large financial stakes should be required to give up the economic interest entirely.

Enforcement is another point of contention.

The Republican draft gives the U.S. attorney general responsibility for bringing certain civil actions. State attorneys general would also receive enforcement authority under specific circumstances, although their ability to challenge conduct involving federal officials would be more limited.

Democrats have sought stronger enforcement mechanisms that they say would be less dependent on the executive branch policing itself.

Republican sponsors say they already moved significantly toward Democratic demands. Senate sponsors said the latest text incorporated more than 120 requested changes and much of a bipartisan ethics proposal negotiated by lawmakers including Republican Sen. Thom Tillis and Democratic Sen. Ruben Gallego.

The parties therefore appear closer than they were earlier in the negotiations, but Tuesday’s vote demonstrated that significant differences remain.

Beyond congressional ethics, the CLARITY Act would reshape how the federal government regulates cryptocurrency.

One of its central goals is establishing clearer boundaries between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

For consumers, clearer jurisdiction could mean more predictable rules governing disclosures, cryptocurrency exchanges, custodians and treatment of customer assets when a digital-asset company fails.

Supporters argue that a national framework could also reduce years of uncertainty over whether particular digital assets should be treated as securities or commodities.

There are possible tradeoffs.

Consumer advocates and state regulators have questioned whether federal legislation could weaken some existing state protections or limit enforcement tools used against cryptocurrency fraud.

The legislation also contains provisions involving stablecoins and rewards.

It would generally prevent certain providers from paying the equivalent of traditional bank interest simply for holding payment stablecoins while still permitting rewards connected to transactions, loyalty programs and other activities.

Banking organizations have warned that attractive stablecoin rewards could encourage customers to move deposits away from traditional banks, potentially affecting money available for mortgages and business lending.

Supporters of the crypto framework dispute the scale of that risk and argue that preventing consumers from earning competitive returns could favor banks at consumers’ expense.

That leaves Congress balancing several competing concerns.

The CLARITY Act could bring greater regulatory certainty, consumer disclosures and defined federal oversight to a rapidly growing financial market. But lawmakers must still determine how much authority federal regulators should have, what role states should retain and how aggressively Congress should restrict cryptocurrency holdings by officials writing those rules.

For now, the legislation remains stalled.

Tillis’ procedural maneuver preserved the Senate’s ability to reconsider the measure, meaning negotiations could resume if lawmakers reach an agreement on the remaining ethics provisions.

The larger debate is therefore no longer simply whether Washington should regulate digital assets.

It is increasingly about what protections Congress believes must be included before those rules become permanent.
