The U.S. Supreme Court on Monday declined to step into a long-running criminal dispute involving a Maryland physician accused of exploiting the pandemic, clearing the way for a retrial in a case that has become a legal Rorschach test for how far medical billing ambiguity can stretch.

The decision not to hear the appeal sends the COVID scheme doctor suit back to federal court in Maryland, where Dr. Ron Elfenbein will again confront allegations that he defrauded the federal government of more than $15 million by inflating billing codes during the height of COVID-19 testing.

High Court Leaves Lower Ruling Intact

By turning away Elfenbein’s appeal, the justices left standing a ruling from the 4th U.S. Circuit Court of Appeals that found a jury had enough evidence to convict him and that a district judge erred by wiping away that verdict after trial.

The appellate court’s decision reopened a case that once appeared sealed. Elfenbein had initially been convicted on five fraud counts, only to secure a post-trial acquittal — a legal whiplash now reversed.

Pandemic Pivot Under Scrutiny

The controversy traces back to 2020, when Elfenbein converted his medical clinics into COVID-19 testing hubs in Anne Arundel and Prince George’s counties. Prosecutors allege that behind the urgent public health response lurked a scheme: staff were instructed to bill the government for complex office visits even when patients spent just minutes at the clinics.

Those billing choices, known as “upcoding,” formed the backbone of the government’s fraud case. Elfenbein has countered that the medical codes were inherently ambiguous and allowed for differing, reasonable interpretations.

Conviction, Acquittal — and Back Again

After a three-week trial in 2023, a jury found Elfenbein guilty on all counts, exposing him to a potential 50-year prison sentence. But U.S. District Judge James K. Bredar later overturned the verdict, ruling that the government failed to show Elfenbein’s interpretation of the codes was unreasonable.

The Justice Department appealed, and in July, the Fourth Circuit called the matter “close” but concluded that Judge Bredar had gone too far. The appellate panel reinstated the possibility of conviction and agreed the government deserved another chance to prosecute.

Supreme Court Says No

Elfenbein took his fight to the nation’s highest court in early November, urging the justices to decide whether healthcare providers can face criminal liability when they rely on what they view as reasonable readings of murky billing rules.

“The petition concerns the government’s burden to prove the element of falsity,” Elfenbein argued, especially in cases hinging on ambiguous regulations.

The Supreme Court declined without comment, a silence that spoke volumes for prosecutors — and disappointment for defense attorneys watching the False Claims Act landscape.

Legal Ripples Beyond One Doctor

The Fourth Circuit’s ruling has sparked debate among healthcare lawyers over whether coding ambiguity should block fraud prosecutions altogether. Elfenbein argued his case offered the perfect vehicle for the Supreme Court to clarify that line.

Jonathan Porter, a partner at Husch Blackwell LLP and a former federal prosecutor not involved in the case, said the outcome was hardly shocking.

“The issues in the Elfenbein case are somewhat unusual,” Porter told Law360. “It’s not surprising the Supreme Court opted against hearing it.”

Lawyers on Both Sides

Attorneys for Elfenbein and the government did not immediately respond to requests for comment Monday.

The government’s team includes Glenn S. Leon and Jeremy R. Sanders of the Justice Department’s Criminal Division, Fraud Section, along with Jason D. Medinger of the U.S. attorney’s office in Maryland.

Elfenbein is represented by Gregg L. Bernstein, Martin S. Himeles Jr. and Samantha A.M. Kavanagh of Zuckerman Spaeder LLP.

As the COVID scheme doctor suit heads back toward trial, the case remains a legal storm cloud over pandemic-era healthcare — a reminder that emergency measures, like viruses, can leave long-lasting consequences.
